Please Help

Hi Guys
I sell nike trainers on ebay (all legal and above board)
and hace just recieved an email from Hewitsons Soliciters basicaly saying they are either going to take me to court unless i pay damages and £25 for every pair of nike trainers which i simply cannot afford as i only make a small amount per pair
Can Anyone offer any advice please

    On what grounds are they taking you to court?

    Are you sure this letter is from an actual solicitor and not a disgruntled purchaser?

    I didn't know solicitors operate like this, can you give us a few more details. Sounds like a load of old pony to me.

    Are you sure it's not a wind up ? Seems a bit odd for solicitors to be threateneing legal action by email.

    Email them back very politely asking them to ensure the details/claim is posted to you in writing for your solicitor to look at before any action will be taken. DOnt give them any further details and you will never hear back again!

    Solicitors do not write emails! Its not "frightening" enough (for most people). You are being scammed by a disgruntled competitor.

    The only solicitors who "may" be writing would be Nikes own solicitors., They would be the only persons who may be able to claim an infringement on copyright - and lets face it, the £millions they earn from Nike, a simple email would not be their prefered delivery method!

    Sorry to say, but this practise is common amongst ebay sellers (and those with power status!)

    I agree with the others, what sort of solicitor sends frightening emails? It all sounds a bit suspicious. It is more normal for companies to use the ebay VERO programme when they have a complaint against unlicensed sellers.

    Hi Everyone
    The Letter they sent is in an attachment and has my full name and address and my user id
    The address on there website and the address in the email is the same
    and says basically that they are acting on behalf of nike and that because i am importing trainers and displaying nikes logo i am liable.
    They say nike will be looking to recover damages, percentage of profits, Fees and £25 for each pair of trainers sold.
    I just do not know what to do

    Well if you are importing them from one area, and selling them in another Nike's position is that it's illegal. Having said that, just because that's what they say, doesn't make it so. Please note that in the link they talk about unapproved products. I find it hard to believe that every pair of shoes you've sold come into the category of unreleased and therefore unapproved in the EEA. You need professional legal advice.
