dyson vacuum cleaners

hi can anyone give me some advice please. about my broken vacuum cleaner please .dyson will not repair it and my guarentee does not run out till the 4/4/06 all because i have lost my receipt.hope someone can point me in the right direction. thanks andy :mad: :mad: :mad: :mad: :mad: :mad: :mad:

In the absence of a till receipt a bank statement showing the date you paid for it (if done by card or a credit card statement showing similar is what you need. Under trading law they are seen as equal proof of purchase.0

I AM SURE THAT IF YOU TAKE IT BACK TO THE RETAILER WITHIN THE GUARENTEE PERIOD IT IS FOR THEM TO FIX. YOU DO NOT HAVE TO HAVE THE RECIEPT AS THE ONUS IS ON THE RETAILER TO PROVE THAT YOU DIDNT BUY IT FROM THEM. EG A FEW YEARS BACK I BOUGHT AN IRON FROM ARGOS THAT BROKE WITHIN THE GUARENTEE, THE CS SAID I NEED A RECEIPT AND I SAID I DIDNT, SHE SAID THAT I COULD OF BOUGHT THE IRON FROM ANYWHERE, TO WHICH I REPLIED THAT THERE IS A BATCH NUMBER ON THE IRON AND IF THEIR STOCK SYSTEM DOSNT RECORD THE BATCH THEN THE SUPPLIERS WILL AND IT WILL SHOW THAT ARGOS WAS THE PURCHASER. RESULT CASH BACK, NOT VOUCHERS BUT CASH.
THIS IS FROM THE YELLOW PAGES NEAR THE FRONT UNDER CONSUMER INFORMATION (PAGE 11)
"YOU HAVE THE SAME RIGHTS EVEN IF YOU LOSE YOUR RECEIPT, BUT IT IS USEFUL EVIDENCE OF WHERE AND WHEN YOU BOUGHT THE GOODS".

Have to say i disagree here.I have read this myself in yellow pages and i think its badly worded, a bit economical with the truth.If you understand the problems retailers have,anyone (and they do!) could buy a broken product from a jumble sale and take it back to ANY shop saying they bought it there.The retailer must have some protection,surely.There has to be a logic to how this law is written.What they are referring to is your statutory rights,but also the retailer has rights too.Do you understand,the point i am making.I find this a dilemma,and would be interested on the final solution,so let us know the result.The retailer will often in effect be saying,"i dont know if i sold you this".0

I AGREE PARTIAL TO WHAT YOU ARE SAYING, BUT DYSON WILL BE ABLE TO TELL WHEN AND WHO THEY SOLD IT TO BY THE SERIAL/BATCH NUMBER, IN THIS INSTANCE ARGOS. ALSO WOODI147 SEEMS TO KNOW WHAT DATE THEY BOUGHT IT ON. NOW WITH ALL THAT INFO I THINK EVEN WITHOUT THE LAW, I THINK THERE IS ENOUGH PROOF TO WHERE THEY BOUGHT IT FROM AND WHEN.0 -
I cannot find any reference to this item being purchased from Argos. If it was, then going back to the store it was purchased from and armed with the date may help them pull up the transaction (if they can that far back. It might be worth looking on the Argos board as some of their staff post there).
There is no onus on any retailer to accept for repair items for which proof of purchase cannot be provided. This proof does not have to be a receipt but can be a credit card statement or bank statement. The retailer does not just have to accept that an item was bought from them and although it might be good customer service, they are not obliged to search their records for the transaction just because you can't prove you purchased from them.
With regard to the issue of "taking it back in the guarantee period" how are they supposed to know it is in the guarantee period if you cannot prove when it was purchased.
In addition, if it was purchased from Argos it is to them the machine must be taken. There is no contract with Dyson direct unless it is past the 12 months Argos offer and part of an extended offer by Dyson.0 -

AS THE LAW STATES IT IS FOR THE SUPPLIER TO PROVE THAT IT WAS NOT BOUGHT FROM THEM.
AS FOR ARGOS THAT IS MY FAULT I USED THEM AS AN EXAMPLE AND CARRIED ON FROM THERE.

IF YOU SUPPLY A CREDIT/DEBIT CARD STATEMENT THEN WHY IS THAT PROOF, AS IT WONT SAY WHAT YOU HAVE BOUGHT. THE LAW AS IT STANDS STATES THE OPPOSITE FROM WHAT YOU ARE SAYING, IT IS FOR THE SUPPLIER TO PROVE THAT IT WASNT BOUGHT FROM THEM.

after looking at a few replys on here .decided to send an email to dyson
telling them about my vacuum not working properly. a very nice gent called ian rung me from dyson and asked about all the problems i was having with my vacuum .he did say my guarantee had only just run out. but as a goodwill gesture he would replace various parts free of charge.
so iam very happy at the outcome and gratefull for all the help and advice on here and would like to thank you all :T :T :T :T :T :T :T :beer: :beer: :beer: :beer:0
