bailiff help please

    ok.. an update.

    Yesterday I tried phoning the councillor, no answer and no answer phone, so I emailed him AND sent a copy through royal mail.

    I then got an idea and because I took legal protection on my household insurance, got a name of someone on a legal team to flaunt under some noses, they pretty much confirmed what you'd already said here :)

    I then phoned the council, and after speaking to a couple of advisors, finally got the deputy of revenue collections and told them exactly what was going on, what paperwork I have and pretty much what you said to tell them about the invalid levy, illegal fees, invalid walking possession etc and after getting rather forceful with her and letting her know I have already printed a letter out to complain to the police because I believe the bailiffs have tried to defraud me, I got a brainwave...

    I asked her to confirm what is on my statement of account.. and she said that all that is there is the LEGAL fees of 42.50 (24.50 for first visit, 18.00 for second) and the original liability.. so I asked how she felt about the bailiffs trying to CONCEAL fees from them !! and how that must look to us council tax payers, because they appoint and are accountable for these incompetent and fraudulent bullies.. and she said they'd never had a problem with them before, which I find highly unlikely.

    I told her all about the 110.00 fee for "other" and also the discrepency in the balance outstanding on the 2 documents etc etc and she asked if I wanted a complaints pack (lol).. oh yes, I do !!

    anyway.. to make a long story short.. on monday I am going to pay, TO HER (I have an appointment) the original liability, and she will issue me with a statement and she will sign a letter stating the debt to them is paid in full.. (Im taking a witness too, just incase)

    she also withdrew the bailiffs "with immediate effect" from my case.

    however, she did say she couldnt foretell what the bailiffs would do and said they may try to enforce for their fees, and I said they are more than bloody welcome too because I have been told what they can legally charge, but I have written evidence that not only do they change their minds about how much to charge me, but because they have tried to charge me illegally etc, I will just phone the police and the local papers.

    I do find it a little strange that she didnt ask to see any paperwork though, she took my word for it.. hmmm.

    but anyway, there you go :)

    the only thing is, I cant find the certificate number or the court that approved this second bailiff, any ideas please ??

    Glad things are moving screwball.

    I don't have the resources to dig out bailiffs certificate details to be honest, I know Herbie can do it so guess who I'm gonna suggest trying to get in touch with again for that one.

    Other than that...

    Good work. It sounds like the council have realised how badly this has gone and that you won't put up with that.

    help i have the bailiffs pestering me for money i am paying. the bailiff wanted 220 unpaid council tax, but i only owed 112. they have never been in my house at all. and another thing is that they really embarrassed me by telling my mother in law about the debt. now my life is such a misery because he has told her this.and she just tells everyone and anyone. is a bailiff allowed to do this. and tell people about it???

    David2903, you might do better off starting your own thread for this.

    1. You need to find out how much of this is the council tax itself, how much of this is the fees, and what they claim the fees are for. The court costs for the LO plus (say) first and second visit fees could easily take a debt into that region.

    You've presumably read the rest of the thread so I won't insult your intelligence or waste my time repeating things that myself and others have already said here.

    2. What's the context of them telling your MIL? If they visited the property while she was there by herself and gained entry, of course they'd say why they were there. If they're contacting random members of your family out of the phonebook to discuss your problems, then that of course is a whole other thing.
