£12 credit card charges

hi everyone is it worth me claiming the £12 charges on my credit cards, has anyone had any success stories in claiming these £12 charges

    Browntoa, can I clarify if you are saying that the OP shouldn't claim the £12 charge back?

    I really do not want to challenge you on this(as you are a board helper) but I am gonna have to if the answer is YES.

    I'd be interested in this also - any success with credit cards and this £12?? My daughter had a £12 charge last month, and I was inclined to tell her to take it on the chin and learn - and set up a DD to take the minimum payment!

  • Read OFT842 paragraph 1.14

    "1.14 It must be stressed that this is a statement of our position and reflects the exercise of our discretion as an enforcement agency. Only a court can decide finally whether a term is unfair, or at what level default charges should be set to meet the requirements of the UTCCRs. It should be kept in mind that other enforcers may apply for injunctions under the UTCCRs and that the UTCCRs may be relied upon by consumers in private claims."

    Hmmm, what does that mean? :D

    I'm not sure as it goes, hence the "suspect" bit at the end

    Martins Article does say you can reclaim the difference between £35 and £12

    Yet it certainly has made it a lot easier to reclaim back the difference between what you were charged and the £12 figure. So for each £35 charge, you should get at least £23 of it back; though many people actually get the whole £35.

    but rereading the article it seems to say reclaim the lot ...so maybe I'm wrong.....

  • Martin, should say claim the lot back as he does with Bank Charges, imho, however, I can understand why he doesn't necessarily go as far as saying that considering that not everyone would be confident enough to go after the full amount because of a regulatory body not having the gumption to litigate, which I think they may revisit after the Bank Charges Test case. since the £12 was due to be a temporary measure.

    I am doing exactly this with Capital One i have £336 of charges which are all £12 a time..
    The papers have been served by the court 6 days ago and am still waiting for a responce from capital one

    the way i see it £12 is still way over the top i think £3 to £4 is fairer

    i will post when i get a responce and let you know if your interested..

    Hi.

    Can anyone point me in the right direction to the template letter to send saying that my charges are credit card charges and not bank ones so Im still be able to claim back.

    Cant seem to find it.

    I sent the 1st letter saying that I want my money back but they got back to me saying that its on hold when its not as I want to reclaim credit card charges not bank ones.

    Hope you can help.

    Would just like to add that my OH has just successfully claimed Credit Card charges from Barclaycard some were £20 but the vast majority of were £12.

    It can be done.
