I think if the Son doesnt know the rent isnt being paid, it is possible that he could be paying his half of the rent to his Mum and she is not passing it on. If this could be the case then I think he deserves to know what is going on! Are they both named on the tenancy or just the Mother? she is already half a month behind which is £330 and 2 weeks late on this month. this totals £960. for a month i would lose £630, which is money i dont have. what i get for the rent is to pay the mortgage and everything else to do with the house.
What will you do for money if the boiler breaks down?
Did the tenant give you a deposit and if so, did you protect it and then give the tenant the prescribed information? You can't issue a Section 21 if you didn't put a tenants full deposit in one of the schemes.RENTING? Have you checked to see that your landlord has permission from their mortgage lender to rent the property? If not, you could be thrown out with very little notice.

You must stop dealing with your tenant in person and by telephone. Technically she is entitled to 'quiet enjoyment' According to the tenancy agreement rent must be due on or before a certain date - if she is going away she must pay you in advance. Either send the section 21 notice or a formally worded letter quoting the tenancy and the dates of non/ late payment. Give her a clear date to pay up and send the letter/ section 21 recorded delivery.Declutterbug-in-progress.⭐️⭐️⭐️ ⭐️⭐️0

thank you so much for your advise. i dont like being nasty to people but this has been getting a bit much.
is it normal for a landlord to have to ring and arrange to collect the rent?? i did this with my last tenant and really didnt have too much of an issue although it did get a bit much having to keep going round to pick it up. this time i have text rung etc, im sorry i understand she works and i dont mean to be funny but surely if people want a roof over their heads then shouldn't they make an effort too.
the son i think has been kept in the dark, as mum deals with it all. he has been designing his garden and doing other bits with mates. but surely if she wants to make sure that she keeps it going for him then the rent must be paid??!!!

Did you do credit checks before taking your tenants on? This really needs to be done along with work references, pay slips etc. You also should get a standing order in place for rent before the tenant moves in, as no, you shouldn't have to be chasing it up. As already suggested, serve notice at the appropriate time.
It is very easy to want to be nice, but letting is a business, and you need to take on board what needs to be done. For all the great tenants out there, there are ones who are looking for a soft touch and will take advantage. Join a LL's Association for advice and support.
It might also be worth having a word with your tenant face to face to see if there is a reason for the lack of payment. You don't state how she pays, ie from own earnings or housing benefit, but the only time I ever had non payment was when it was tenants on HB, and they had spent it on other things! :rolleyes:

I am a tenant and if I didn't pay my rent on time I'd expect to get evicted! It's not normal for you to have to make appointments to collect the rent - it's usually done by Standing Order.
If the son is named on the tenancy then I think he has a right to know what's going on. However, if he's not then you have to be careful as you do have a duty to keep the tenant's affairs confidential.
With a S21, I don't know if they are issued to the tenant or if you can issue one to "The Occupier". If you can do the later, then it may be a good idea to deliver one when you know Son will be in and Mum won't be?Happy New Year :beer:0 -
Hi, I am not sure on the legal side, but once this is sorted, if i were you i'd work hard to make sure i have at least 2 months mortgage payments and bills saved up, otherwise what will you do if house is empty between tenants?? and as someone else said what will you do if the boiler breaks down? or a pipe bursts and floods the place?
you are skating on thin ice if you have no back-up plan...0 -

So you admit it yourself, it is not nice to not be paid... If the LL is paying the mortgage (or at least paying towards it) with the rent, then what right do you have to not pay at the agreed time?
As for the other guy on about 'difference between LL's and tenants', I am a tenant.0
