There are a number of points we don't know (unless I missed something) Did the other guy always earn more or did he get a payrise when he got his diploma? To be honest I think the pay difference isn't unexpected for difference between NEBOSH Cert and Diploma. The pay of the other people in same role would be good to know. This would be far more indicative of a problem than comparing these two people. It will be interesting if you can let us know what you find out about the other people's salaries.Sell £1500

It has everything to do with qualifications. This is one area where it is INCREDIBLY likely to have an effect on salary.
You also have the opinion. like many here, where if someone does not put their arm around someone and tell them what they want to hear, you dismiss them as being incorrect and the troll accusations start flying.
Your post quoted above just proves how little about the problem the OP is having you actually know.

my blood pressure is fine Pete. I know we are approaching this sensibly and correctly so i dont take much heed of the likes of woody acting like some hotshot from dragons den. if the company has a case to answer (in the opinion of the Solicitor/Eq Comm) on the equal pay issue we will pursue. If they make my wife redundant after a flawed selection process (which has already raised concerns at the Labour Relations Agency) we will look at that too.0 -

So why not acept you are wrong rather than trying to get personal? Ignore what you will.......you are 100% incorrect and giving misleading, false and uninformed information.

You may well have a case regarding the selection procedure for redundancy. No one here knows enough about the case to give you a firm yes or no on that.
It's the equal pay issue that unfortunately, regardless of what advice you are getting from some of the others, is a no go and there simply isn't a case UNLESS the qualifications/experience are the same between both parties.0 -

Mumps the guy has only been in the company just under 2 years - he started on the high salary when he did not have a Diploma. we know this cos my wife was handed his payrise letter at her review by mistake.0 -

Woody thats what Ive been trying to say all along - the qualifications/experience (when he started) are def broadly similar in our opinion. it is hard to get across on here the full facts of the matter but trust me we are not the type of blodd sucking people that run to court over nothing - my wife has been treated very very unfairly in her job.
I know it will be complex and the company most certainly wont roll over and accept they have been (even indirectly) biased. lets see what happens and the good thing is we havent sent the letter yet so we may need to add the other 3 x advisors as comparators cos there are a couple of them who hadnt got the Diploma for a number of years and we believe were on far higher money. remember my wife asked last year to start the diploma and was turned down firstly cos of the cost (fair enough) but when she said she would pay herself they refused to give her the time off (1 day a week or 1 week per month) to do it despite letting at least 3 males complete their courses with time off so how was she ever supposed to progress? shes also been carrying out the job perfectly well for over 4 years - so well in fact thats shes now Advisor on one of the companies most prestigious contracts. Will a court believe that she is under qualified when that is presented in front of them?
I agree with you about the redundancy process and that is now an issue (not just for my wife I may add) cos the people to go are announced on 6th July. The company sent letters saying 20 people wud be going - fair enough in 2days climate. What they then done was send an assessment form to every director and manager saying "fill a form in for whoever has worked for you in the last 3 years". Now we know that my wifes direct manager on site completed her assessment and scored her very well ("prob the best Advisor we have" was one of the quotes) but when she met the director last week for the redundancy consultation he informed her that he would be doing her assessment and no-one else! she didnt mention the assessment already completed for her. she has, rather cleverly im my opinion, followed up on that meeting with a polite email recalling they had met previously about her pay he admitted "i dont know what you do in your job cos Ive no day to day involvement with you" so why isnt her direct H&S manager and Site manager assessing her (like they are assessing others). how can he assess her and why is he not considering the assessment already completed for her? i'll leave you to draw ur own conclusions from that......
he phoned her for a private meeting this monday to discuss her concerns0 -

Also how do you know there hadnt been previous payrises or what he started on.0
