Egg on-line credit card applications and PPI

Can you tell me if anyone has actually been successful in claiming PPI on an on-line application Egg card. I have had 2 'no' letters saying I ticked the box when I do not believe I did. I have been looking through the successes and can find Egg success stories for loans and cc sold on telelphone but not for on-line applicants where Egg say you selected it and have enclosed a snapshot of the application form. I am thinking of taking it to the FOS but just thought I'd see if anyone had been successful

    Hi there

    Yes there have been success with EGG in regards of an online sale of this policy, even though its more difficult than phone sales and post sales etc, but the FOS are seeing right through these now and I believe most of them are resolved through the FOS rather than directly with EGG themselves.

    I would move on to the FOS now if that was a final response, if that was not final then write back until they say its the final decision, good luck and please keep us posted.;)

    Hi Becky

    It can be a lengthy process, due to these amount of complaints the FOS are dealing with currently but, if you have financial difficulties its worth making them aware of this, for example arrears with the mortgage etc etc and ask on the form if they are able to consider "fast tracking" for you.

    However, some cases as soon as they are received and passed onto the adjudicator, this is the one of the longest periods, but as soon as they receive your complaint and the other party they will get onto it straight away, and some can be successful in a matter as 6 weeks from when they receive your complaint.;)

    Can anyone help?

    I wrote to Egg in January 2009 regarding mis-selling of ppi on a credit card I took out in October 2002. I cited the reasons for this as being fined by the FSA and that the policy was not in my best interests. I received what appears to be the standard response of card purchased online, Egg do not provide an advisory service as part of online sales process, I was asked to read the terms and conditions governing the policy and specifically confirm that I agreed to them. In addition, a copy of the terms and conditions were sent out prior to purchase of the policy being completed. They also enclosed a copy of the 'real time application' which also appears to be the standard response. Interestingly it shows my length of time in my current employment as being 6years 6 months, which as I was 20 at the time of the application would have meant I had been employed in a telebanking centre since the age of about 14!

    I initially gave up on this matter thinking that there would be no point in pursuing it but then decided to challenge the decision in May with the following response

    You state that the insurance was selected via an internet application and that I had to confirm that I agreed to these terms and conditions, which were confirmed via a paper agreement which I was required to sign prior to the policy being completed.

    I have examined my own copy of my credit agreement and there is absolutely no mention whatsoever on this agreement of any insurance products or payments regarding any insurance products. I was required to sign this agreement and return it to yourselves accepting the credit card. I signed the agreement and returned it to you, however at no time have I signed to accept any insurance on this credit card. Therefore I do not accept your response, and challenge your statement that I signed for and accepted this insurance.

    Also I would like you to provide proof that the payment protection insurance for this agreement was an opt-in option and not an opt-out box automatically checked during the application process, as I do not believe that this product was a selection that I made during the application process.


    I then received the following response:

    When you were presented with a yes/no option regarding this protection on selecting yes you would have been provided with a link to the terms and conditions of this cover and asked to carefully read and agree to them. You would not have been able to proceed with your application until you had agreed or gone backwards and selected no. Full information was provided on website to enable you to decide if insurance right for you blah blah and please find enclosed an example of the screen you were presented with - this letter was accomplanied by a printout of an Egg screen with sections on additional card holders, PIN and would you like to ensure your card balances.

    They also state that a paper copy of the terms and conditions were included with two copies of my Egg card agreement, of which I signed one copy. Apparently this shows that I received paper documentation prior to any premiums being added to my account. This is in line with distance selling regulations, which they have then gone on to detail. At the close of the letter they they state that the "CRP is a seperate insurance and is not detailed on your Egg Card agreement"


    Is there any point in pursuing this matter any further? Doesn't appear that Egg are going to budge.

    The FOS to what I am aware of are dealing with loads of these complaints, especially online selling via EGG, and are getting used to their tactics.

    I would keep trying, by either writing back to them if this was not the final response, and tell them you want this reconsidered, as you stand firmly on your reasons of why you were mis sold the policy.


    Then in the final letter they should give you the details of the FOS if eligible to go this direction.

    So do not give up right yet, good luck.;)

    I read about FOS guides on this and they can ask for the screenshot of the online application of these. I will try and find out but I think that sometimes it was actually pre ticked and you had to opt out which was wrong.
  • I'm in a similar position - Egg have just insisted that as I bought it online, I opted in. They also supplied me with a lot of duff information in their records of application (unless I really started work at 11 years old) so I'm wondering if they've resorted to just making stuff up.

    Has FOS ruled on this? Does it make it fair to push unnecessary PPI just because you're doing it online and not by phone? Anyone with any similar examples would be helpful.
