is this legal?

My mother ordered a fridge freezer which was "delivered" yesterday.

When I say delivered it was left outside on the front path as the driver refused to take it up 2 steps into the house- he said that he wasnt covered for steps.

Now my mother is a pensioner, lives on her own and 300 miles from me. The fridge has been left out over night and again today. A neighbour has kindly offered to help, but should it be moved?

Does this constitute a delivery or is the onus on the company to provide adequate manpower to deliver the item into a premise?

  • It depends on the companies terms.

    Delivery has occurred and unless they stated it would be delivered into the house then they have met their liability I would imagine.

    Its an outrageous way to treat a pensioner.
    Write to them and complain even if they have met their liability. And dont shop with them again if you dont get an apology.

    the 2 steps are into the house, but had the two steps been between the pavement and the boundary then they would not be able to leave the item on the pavement and would have to negotiate the 2 steps.

    seems inconsistent dont you think?

    He moved it from the van, didnt he. All houses have one step at least into them. Would he leave any delivery of any itme at the door of every customer. I think not.

    the other thing if the fridge was to heavey for one man to carry down the stairs how did he get it off van and why did they not supply him with a mate to help carry the fridge ..

    Had it been me, i would have made the driver wait till had checked the T&Cs, only if it was there would i have signed for it. if the rule wanst there, i would have told him to take it away again and refused to sign the delivery note.
