I know Comet are crap but any retailer does have the right to inspect goods before giving a refund thats why they insisted on seing the goods first and sending someone out.

Well they will want to check them - they can hardly give a refund before they have the goods back!

well trading standards have done us well

after speaking to them they sent me some letters to sent to Comet & Barclay Card - with leagl reasons and the parts of relavant consumer laws
pinpointing why we are due the refund

the letters are excellent and very detailed so hopefully this will do the trick

  • Do a search on grumbletext.com for comet as they get an awfull lot of flack flying their way on there but they may have posts with names of people to contact who will sort things out for you in about 10 mins flat.

    SUCCESS

sent the letters promising court action- as directed by TS on Friday - signed for.
Monday morning we got a call from a very apologetic manager at the local comet who claimed he new nothing of the matter and was shocked to hear of our problems.

He promised to call us back later in the day and he did but was really pushing a discount for the cooker or a replacement.

Stood our ground despite him telling us the comet legal team and TS had told him we had accepted the goods and had no grounds for a refund.

I also knew the girl who claimed she was the store manager was listening in on another phone. I just kept quoting the trading standards advice that we were forced to use the goods as comet didnt want to do anything about it etc and after a few mumbles in the background between them he offered to refund the costs - despite the fact we would lose in court but he really didnt want to waste a day to attend.

Refund is due Thursday and the cooker will be collected to be resold later next week.

My parents were just about to drop the matter thinking it was too much hassle.

Now, here is a big question.
Of the other big retailers - who are the good guys for customer service??

I wouldnt be sure, but if you use the goods AFTER saying they are faulty are you not accepting that they ARE fit for use ?

As for who is "good" .. I would imagine that any retailer large or small would not want to take goods back unless it is a manufacturing fault as they will suffer the loss, and its unlikely to be covered by any insurance they have unless it is delivered by a third party courier and you sign that the goods were received damaged.

Congratulations on a battle won, and on having the determination to keep going with it :)
I wouldn't touch Comet with a barge pole to be honest, and even more so after reading some of this.

We buy all our electrical goods from John Lewis where possible - they give a free 5 year guarantee with TVs by the way, and price match high street companies (although not online retailers' prices)

We've also had good service from Tesco on line, for smaller items, including a kettle which they refunded some time after it had been used and developed a cosmetic fault.

its daft but we have more rights by law on goods we buy over the internet or mail order tha goods we buy in store

the problem with comet is that they are trying to give the shareholdes more money buy screwing the customers and denying customer rights

bad business as any good firm knows the customer is king
