faulty xbox 360

:mad::mad::mad::mad: i bought my son an xbox 360 in december 2008 (xmas present) and now it wont work so i went to the store where i bought it and they said they only give 28 guarantee and had to contact microsoft so i first contacted the stores customer services and they said that was right so i got in touch with xbox and they informed me that the warranty on the xbox actually expired 29th november 2007 so a good year before i actually bought it so basically they sold me an out of date product i have been back in touch with the store but not yet heard back so where do i stand here and what can be done

i am so frustrated

    warranties begin on the date of purchase

    i believe microsoft now offer a 3 year warranty on xbox's because theyre a pile of turd and overheat and they know it

    anyways opinions aside

    tell them that warranties begin from date of purchase and provide proof of postage if you can

    if microsoft refuse still then write to where you bought the xbox from saying that you want a repair or replacement of your product under the sale of goods act s 14 regarding "durability" and that if they do not reply or resolve the matter in 14 days you will contact trading standards and take them to small claims court

    either that or continue to pursue microsoft

    really you should be doing the letter to the retailer but microsoft may be the path of least resistance
    Back by no demand whatsoever.

    What you could do is:

    reduce the size of your font and add some punctuation...

    After you've done that, you could look up the Sale Of Goods Act and see that it is the retailer who you bought it from who needs to sort it out, not the manufacturer...

    Definately the retailer you need to deal with.

    I thought your receipt was your garantee for 1 year? Or more in some cases.

  • Xboxes come with a standard one year warranty, extended to three years for the RROD faults.

    These warranties are supplied directly by Xbox and are very efficient. you also normally get a free gift each time too.

    Seperate to this you have SOGA protection which is against the retailer. Yes you can insist the retailer deals with it but if it is under warranty you are far quicker going to microsoft direct in most cases outwith the initial 28 day period were most will replace/refund.

    In your case if microsofts information is correct you have either bought knowingly or been sold in error a used unit. You can contact the merchant re this if it is the case and demand your SOGA rights be implemented.

    Sending it to back to Microsoft to be repaired is probably the best option, Gave me a months free Xbox live Gold when it came back.

    OP, who was the retailer you bought it from, i got mine from gamestation and it had 3 red rings after say 7 months so i took it to the store i got it from and they swapped it for a new 1, you also mention that the warranty expired before before you bought it so was it a completely brand new xbox 360 or was it a second had 1, if it was a brand new 1 then what i think has happened is the store has sold you a second hand 360 which would explain why the warranty had run out before you bought it but this is my view of the situation
  • sorry about big font people i have just checked my records and to my shock i only bought the xbox in march 09 and not in december 08 i am still waiting to hear back from the stores customer services to see what they going to do before i go to trading standards i am now begining to think like others that i was sold a second hand console instead of a new one but not sure if the store sells second hand stuff p.s the store in question is sainsburys so i will post again soon

    i can confirm that sainsburys do not sell second hand goods, when you bought the xbox was the seal intact or broken, when i say seal i mean the big round sticker thatholds down the flap on the cardboard box, what exactley is the fault, have you asked said store how the console was registered with microsoft before you bought it
