Suspended from work!!!! Needs some Help

hi there,

I work for an int. bank as a network engineer and over 17 months i've been with them, during this time i'd three managers. Since I've this new manager my life is like a hell at work.
But let me go to main point. 15th of may I've been called at manager office and in the presence of HR I've been suspended from work because of abusive of Phone system, as I'd setup a call forward.
This was setup for business purpose and my manager knew about it in a verbal discussion we'd.
Anyway I'd first meeting with manager and HR (Investigatory meeting) to take my statement and see if it match the evidences they had. During the meeting they mention that they had a call log but didn't provided on several request.
My Case was that since we move to another floor my comapny blackberry(BB) was not working, and also my BB was going dead and i'd report a call for repair in the system for over two months. during this time I'd one2one with my manager and describe the situation, he asked to send him an email for the replacement bb and I'll aprove for replacement. He approved it and later I got a new BB in replacement. But during the meeting he refused that he remember any converstaion. Also, we were experience another problem on that floor that we're unable to dial international mobile number from our desk phone. I've also reported that issue with our technical team and discuss with my other colleagues which is recorded.
Long story short, My manager has reffered the case to disciplinary hearing now to take further actions he think I've not said what he had a log etc. He'd not provided any log to me to see what he's talking about.
I've asked HR to provide my email access where I'd all the evidences, also

With regards to my Manager, I've a very fragile relationship with him. Since he joins he didn't like me at all. He asked to do somework which I didn't feel to do for him and asked him why he's asking me to do?
He asked me to setup up his meeting with the Big Boss in USA? but I talk to another manager and he asked me why you doing this? in return I send him an email that other manager in US is asking me why i'm doing this?
the he try to cancel my holidays, which was booked six months ago, and I'd a very hot email converstaion with him over and it's can also prove in my work email.
Then he start giving me technical writing work, which he knows I'm not a technical writer and my job is mostly doing more practicale work. I asked him that I need training and he didn't respond to me at all. The over two months he was refusing my documents with millions of comments, even though he sends me a template and I'd used the template exactly he wants but it never make him happy.
Then he cancel my approved practicale training and asked to call training provider to refund the money as he has diffrent plan for it. This not end here.
Then he asked me to take over job responsibilities for a person who had been made redundant recently, and I'd a verbal argument with him that this is not right, as I beleive this work does not exist anymore and therefore the person was made redundant. Which he didn't like it.
Then he give me project management work, while doing that project managment I'd sent him an email showing my fear that if he's keep giving me this work. I might loose my primary techincal skills for which I join this company. Once I raised this, next week I've suspended from work on the reason mention above.
P.S. I'd a verbal discuss with HR, and they suggest me to talk to your manager first with problems and see if he helps, but here you GO.....


I'd like to request all of you who has gone through with these kind of experience please advise and suggest me how shall I proceed further.
Can someone guide me what to do in the next meeting? I've never been to this situation before.

    So your suspended for a call forward set up, is this on your blackberry or office phone?

    Would the forwarding enable you to make calls cheaper on your blackberry?

    I am guessing you are provided with a work mobile however you have to pay for your personal calls, have you been using the call forward function to enable access to certain numbers as you mention something about not being able to call certain numbers on your desk phone?

    You need proof of your emails and the fact that you've spoken to work colleagues about this before, maybe they can provide this information for you? Don't be surprised if your colleagues don't back you up, as I have learnt from bitter experience ! :mad:

    It is quite normal for an employer of this size - international banking? - to suspend ON FULL PAY whilst investigations are carried out. This will give you time to sort out your witnesses and legal representation, so use this time effectively.

    sorry for the typo...............english is not my first language and I appology for it.

    On the office BB I'm allowed to make £25 pm personal calls (if bill goes over £75) they'll give me bill to distingused personal calls, but I'd never used it. usually my Office BB is bill is less than £20 pm. They have a policy for paying personal calls for mobile only. They dont't have a policy for land line.

    I've asked several times why I've not been provided a bill to distinguished my personal calls and business calls, but I've been told that we do not have policy for land line to provide a bill. I've also mention that if ther were no policy why they pursuing to personal usage? Why they've not provided me bills etc to look at?
    Yes, that's right its logged in our meeting, my other colleagues in USA and across europe knows about this problem, even my co-workers has tested that that we were unable to dial the numbers. I've mention all these but my manager he doesn't care about this and refered to take further action.
    Yes, call forward was make cheaper calls than the blackberry, I'd proved it to them, but as I said my manager is not acknowleging any thing I'm saying. Also, I used that call forward number to used it for returning calls to other offices in Europe and N.America and also some project work in Poland. Also, when My office BB was dead, I used that call forward number via my personal mobile as I don't hav direct international dialing on my personal mobile. I've not provided a bill but I'm sure that all the calls in two months should NOT be more thant £75.
    Another point is that usually each week I work at least 55-70 hours a week instead of 36 hrs per week as per the contract. My manager also refused to understand why I'm working on Saturday or Sunday. I was very surprised with this action, as he knows that Saturday & Sunday is the only maintainenece day for Network where we can make changes. I'd work 70% of my weekend for this company so far to meet the objectives.

    The call forward was setup on the office desk phone and to used it during only time when my bb was dead.

    I've asked my HR To provide me access to my emails and my co-workers, as in the letter I've been told not to contact any one in the office without contacting HR. HR will comeback to me about this soon.

    I'm not a memeber of a union. Can I join now and they'll provide a representative to me?
    My evidences are in my office emails, I don't expect too much from co-workers I know they just don't want to get into this sometime.

    You could contact a Solicitor that specialises in Employment Law. They usually give you the first 30 mins free - phone a few local to you and ask the question.

    As for the Union's - they usually like you to have been paying your subs for at least 3 months - although I can't speak from any experience so hopefully someone with more knowledge can enlighten you.

  • Tbh sounds like the OP is taking the !!!! with personal calls on his phones.

    Its quite hard often for large companies to provide a specific breakdown of calls on company landlines without going to considerable effort and expense.

    Heres an idea. go to work. work. make personal calls in your own time.

    So you have been using call forwarding to route calls through your office phone to save money as "They have a policy for paying personal calls for mobile only. They dont't have a policy for land line."

    So you are routing your BB and own personal mobile through your office phone to make calls, unless you have a very good reason for this I dont think you have a leg to stand on.
