orange causing headaches

after coming to the end of my contract at the start of november, i called and did a bit of renegotiating with user retentions. they were very nice and offered to beat the offers i was reading them from the internet, in the end giving me the sony k700i that i was after for £15 a month with 150mins and 50txts on a one year contract. Before agreeing I specifically checked that I could still pay exactly as I had beed doing, by calling up and using my switch card, and that the £5/month insurance would be taken off my package.

to cut a long story short, on both my nov and dec bills i have been charged £2 extra for paying by switch, as well as £5 for the insurance. i have phoned them several times, each resulting in them claiming that either a manager or the person i originally spoke to in retentions would call me back, however this is yet to actually happen.

as far as i see it, they are in breach of the verbal 12 month contract that i agreed with them, but they claim that it is completely watertight and i have no grounds to get out of it. i have demanded that they release the recording that they supposedly have of my 'verbal contract' but haven't got anywhere on that front either. i have been told on 4 occasions that somebody high up was going to call me, but all i have had is a voicemail from someone who left no last name or extension number saying that he will call back again when i am in, despite the fact that the phone never rang and he left the voicemail directly.

any advice would be much appreciated.

    I suggest that you email them, keeping copies of the emails etc. Also show your account number and mobile number on the emails.
    They may respond saying that they cannot discuss contractual details via email. You then have to email them back to say that you are not prepared to enter into dialogue without it being documented, in light of the problem you have encountered. Warn them that you will take legal steps to recover the monies already taken and that you want the contract to be as you were told it would be. They may say that they never agree to the type of contract you thought you had. That's as may be, but if their representative did agree that with you, then they must honour it. You could seek to recover the monies from them through the small claims court.
