How close to 6 months was this?

"for six months after the purchase, it is up to the retailer to show that a fault on an item is down to the actions or misuse of the buyer, rather than an inherent fault in the product."

Also other info/links in there that might be useful.

We bought it in the beginning of october.. and called them in about march I think.. its taken them so long to sort it and I stupidly didnt write down dates..! grrr..!

There is not a fault as such, the item is not fit for the purpose specified by the buyer at the time of purchase.
    Gone ... or have I?

when they say for occasional use only, ive always thought that referred to the bed part, not the sofa

Me too, we have a sofa bed and a matching sofa. Both are as comfy as each other and have been used daily for going on 10 years now (think kids using them as trampolines, gymnastic equipment etc too:rolleyes:). The bed, well was never an orthopaedic one:D lol, it definately falls into the occasional catagory.

    It's only a game

    Hi,

But do you have telephone records proving when you first called them - that might be enough? You might be able to say that that was inside the 1st 6 months?

It is my understanding that a sofa bed has a dual purpose (a sofa and a bed), and should therefore be fit for purpose for both uses.

Many people use sofa beds in studio apartments where they will be used daily as both a sofa and a bed. Even if you had bought a cheap and nasty one from Ikea then you should still expect it to last a few years. You have paid a whopping £900 so have the right to expect it to last quite a good few years being used for both purposes. After all sofa beds are used more often as sofas than beds.

I am sure you will get a more satisfactory response from head office, and £200 to re-fill some seat cushions is ludicrous !!

Let us know how you get on.

    Hello!

Just an update for you all..!
I contacted consumer direct for a bit of advice as well, and they advised that it seemed as if the shop had broken the Misrepresentation Act when selling the sofa.. so armed with this information I wrote to the Head Office.. I sent the letter on Tuesday.. the letter was directed straight back to the store..!

I received a phone call today saying that we can go in and choose a replacement sofa, or get a full refund! :j

Am so chuffed.. no more numb bum! We'll be popping to the store this weekend to see if there is another one we like, but if not we will get the money and go else where!

    Yay!
  • Nice one. :) Happy shopping!
