ESA Appeal advice needed

I'm in exactly the same boat as you. I suffer from depression, anxiety and agoraphobia and was only given 6 out of 15 points. Going to appeal if but not really sure it's that worthwhile, ESA seems impossible to obtain anyway let alone if you have a mental condition. They are telling are telling poor veggyboy he's fine to go out and get a regular job?!?!? And I dont even look like theres anything wrong with me.
The 'doctor' I saw was rude, just grunted to any answers I gave and kept making me repeat myself as he didnt understand or speak very good English. The fact I have lots of pets seemed to go against me, apparently because I have that responsibility I am perfectly able to function in the working world??
The really frustrating thing is I want to work properly and normally! I dont like beings a benefits bum and want a job and to get on with my life normally but I need help doing that. Job seekers isnt going to do it. That would be my worst nightmare, the awful crowded job centre with really aggressive people hanging around outside and the staff in our one all seem to be awfully rude and treat everyone like dirt. That way I dont think I will ever be able to get a job as they wont give me the help I need. What am I supposed to do?
The annoying thing is for all us ill people, all this b*ggering about with benefits exaserbates our conditions and makes us even less likely to get a job!Some people feel the rain...others just get wet0 -
That is probably true but is the ATOS doctor, who's background was in a totally different field, somehow more qualified in my condition than my Consultant?
It seems from my experience that regardless of what their field of expertise is their hands are tied by what the computer in front of them throws up when they enter your diagnosis.Depending on how you look at it i was lucky and mine must have been on there and I was out in 10 minutes.If i had not had a specific diagnosis I have no doubt by the sound of it I would have failed even though my illness was severe and I had letters from specialists coming out of my ears.0 -
Are you likely to have success?
No, probably not, but you can play the system by appealing it and staying on for another few months. Its paid at the same rate as JSA so there is little to lose out on financially. Conditionality still has to be met ie. Med certs etc.0 -

And what qualifies you to comment on anyone with a health condition then?Some people feel the rain...others just get wet0 -
Some people would find the appeal process too stressful or not be aware of their rights to appeal, I have certainly heard of such cases.
The situation with ESA is better in one way because you can retain the ESA assessment amount when you appeal. With IB/IS you would have to claim reduced rate IS or JSA.

HI i have been reading all your comments i have been signed on to esa since nov 08 when i had a mental breakdown leading to really bad depression i had my medical back in feb 09 they turned me down as i seem to look normal on the out side but inside is my problem with depression because i went to medical not looking like a tramp that went against me so i appealed with there discission as other things they turned me down on so now i an going to the tribunal on 7/7 as my doctor says i am severly depressed and stressed he is supporting me 100% all the way the medical people have got no idear of what goes on inside my head . like today i am having a really peed off day and crying so you cannot tell me thats normal !!!! I would love a job i still try and look for work and apply for jobs in the mean time.

I do go to work suffering from these afflictions it's not easy believe me, do so plenty of others.
I work days 5 x a week.
I can either sit on my @r$e being miserable and blaming the govt or go out and do something about it. I choose the latter.Be happy, it's the greatest wealth0 -

How do you know if your "afflictions" are in any way equal to "gibboelli's" or anybody else for that matter?
Anybody who has really experienced these kind of problems will know that your attitude is like telling somebody with a broken leg to take an asprin!0
