Which is my fence?

I know this has probably been done to death but i'm keen to find out who owns the fence at the bottom of my garden.

This fence is the left hand side fence looking from the back of the house behind mine?

ie. my back fence their left fence.

I've seen that this issue can be quite complicated, the posts for the fence are inbetween each panel and we have the good side.

I gather i could get the info from the land registry, does anyone know exactly what i need to determine who owns certain fences?

    Very difficult, expensive too if in a dispute. Basically if it's on your land it's yours. Other than that it may be shown on the deeds.

    I've just been through this with my neighbour. We couldn't identify who's responsibility it was so we went half each. To be honest I think this is the most sensible approach anyway (regardless of ownership) as poth parties benifit from the fence.

    im keen to know as my neighbout to the rear has added a conservatory which is raised from ground level and now means that he and his family can see directly into my kitchen and garden. I wanted to add some trellis to the top of the fence but i guess if its his then i can't do that.

    If you cannot put up some trellis how about growing some bushes or shrubs?

    Had considered it but i kind of want something now. i'd need something 8ft tall from the outset and evergreen. not cheap i imagine.

    Hi ITtim,

    I was faced with this issue a couple of years back when my left hand side fence and end of garden fence blew down in the strong winds we had. Fortunately for me (or unfortunately due to the costs), my deeds (which I hold) showed that the left hand fence was mine (as I suspected) and the end of garden fence 'was assumed belonged to me too'. The deeds quoted 'it is assumed the back end of garden fence belongs to my address'. On this basis, I just went ahead and got them done, therefore it may be wise that you get hold of a copy of your deeds (Land Registry / Mortgage provider) as it may shed some light on this, potentially saving you money in the long run if it shows that its not yours - worth a try.

    Hi ITtim,

    That's generally where they are, although I do know now that it's becoming more frequent that deeds are given to the homeowners to safeguard. I would personally start with your mortgage provider and go from there.

    I read somewhere that paper deeds are no longer used by Land Registry and that some new builds don't have them. It's all electronic now. Why not talk to the neighbour? after all you can see into his conservatory too. He may be amenable to trellis, even cost sharing.

    What's to stop you putting your own fence up on your side and go higher that way? Our rear neighbour had a low fence when our house was built so the builders put a taller one in on our side so its like a double fence.
