    Q7. Do I have to produce a receipt to claim my rights?
    No. In fact the trader doesn't have to give you a receipt in the first place so it would be unfair to say that you had to produce one. However, it might not be unreasonable for the shop to want some proof of purchase, so look to see if you have a cheque stub, bank statement, credit card slip etc., and this should be sufficient.

    This is the DTI interpretation of the practical working of the act. However the written act does not mention that it might be reasonable for the shop to ask for some proof of purchase.

    When I studied this area of law there was a case study for a case of someone who sued a large retailer for faulty goods without proof of purchase. The goods were not own brand and were outside 12 months old but the judge held that it was unlikely a complainant would launch a claim against the company unless he had purchased the goods there. It was sufficent that he had proved the company sold the goods at the time he said. I don't think it was appealed and I think it was to do with white goods. Old age doesn't come alone and I can't be arsed to look in the attic!!

    I remember the case though because there was a huge discussion in class before we were told the verdict.

    Do MOthercare still have those stickers when you buy a new buggy/pram, which they stick to one of the front bars which has the month and year when it was purchased??

    I bought one years ago and they did this, so even with no receipt, they could look at the pushchair and see when it was bought.

    I bought a Mothercare buggy a couple of years ago and they stuck a clear sticker to the frame which had been punched with the month and year of purchase. When I had a problem with the buggy, they just checked this and then did the repair.

    Can she remember this sticker being put on?

    A sticker did come with the pram, she kept it with the receipt and meant to put it on the pram when she started using it, the pram had been kept at her mother in laws till her daughter was born. She took the receipt home with her when she started using the pram but forgot to put the sticker on it, she said it is attached to the receipt.

    She bought the pram quite early, her mother in law lent her the money for it and when her sure start grant came through she paid her back. Mothercare had an offer on at the time so she got £10 off of it, thats why she bought it as early as she did, she reckons she was about 20 wks pregnant at the time. I told her to ask her mum in law if she had any bank statements so will report back later

    Do you mean as proof that MIL withdrew the money to loan your sister?

    If so, that won't be any good, as the money could have been withdrawn for any purpose.

    Without a receipt or the sticker proving when it was bought, it sounds like she is stuck with a broken pushchair:(

    When she had a surestart grant did she have to provide evidence of what she bought with the money?

    No, she got the sure start grant as she received child tax credit, she has a 7 yr old son. Its just the standard £500 and you don't need to tell them what it was spent on.

    You do need proof of purchase usually.Looks like trading standards is the answer.They are breaching your statutory rights.,(so because they are in effect faulty the proof of purchase may not be relevant).Trading standards may prosecute. They offer 1 year guarentee on this product,its a shame you cant find someone in the company who is approachable.Has she tried showing it to her midwife,or health visitor,they might be able to exert a bit of pressure,on the safety front,dont they have links with mcare now re the bounty packs?
