I never said a penalty notice shouldnt have been given. However, if the penalty notice was filled out incorrectly then I would contest it on these grounds. Call it nit picking if you want but I would adhere to the RULES inthat they must also fill out their paperwork to the letter also.
I dont usually bite from troll bait however I thought I might clarify my point for those who sit on their perfect ivory towers.0 -
And since the OP buys a half term ticket I cannot see how she is really dodging the fare (since I imagine a new half term ticket is now in force). I'd contest it too.
She would not have had a valid ticket if she didn't have a ticket that was valid on the Saturday.I consider myself to be a male feminist. Is that allowed?0 -
You said she boarded at an unmanned station. Does the station have ticket machine or a permit to travel machine?
If it doesn't, then penalty fares won't apply from that station.
Also, could you look up the station at http://www.nationalrail.co.uk/stations_destinations/ then post back what it says under the Penalty Fares section.
If you could post the station name, that would also be very helpful.0 -

So the willingness to pay, innocent mistake, history of always paying and fault of the first inspector all still escape you do they?
Do you honestly suggest that you want to live in a world where people are penalised in such circumstances?0 -

I fully acknowledge my mistake.
I should have remembered my daughter had broken up the day before, and in future, I will extend her ticket by 1 extra day, to cover her Saturday journey.
But the inspector is there to do a job..collect fares and inspect tickets.
Also, the penalty notice, should like a parking ticket, be correctly filled in. It asks for a parents name, if the traveller is under 18, and that wasn't completed. No reason was entered for the penalty notice, plus no time for the offence, and the Authority number of the issuing inspector is required, and none of this was included.
Giving a young person a penalty is quite a frightening experience, especially a disabled one, she should have been given the option to pay for her journey.
I will be more careful in future.
On looking up the station details, it does state that penalty fares no not apply when travelling from her starting point.

Don't pay the penalty fare. The most they are allowed to charge is what you'd pay at the ticket office for a single (i.e. no penalty fare). It doesn't matter if the inspector checked the ticket or not, they still can't charge a penalty fare. Write back to the TOC saying where the journey was started and that a single ticket is the most you'll pay.munchings-n-crunchings wrote: »On looking up the station details, it does state that penalty fares no not apply when travelling from her starting point.

There you go, then. Case closed. Did the inspector actually ask where she boarded? You could now sue them for the distress caused.I consider myself to be a male feminist. Is that allowed?0
