I have got something on that if it was that. Were you overdrawn in November 2008? or is that when the charge was taken out originally ie the first charge and not the recent one?
Username is 'Mr Scabby' no mention of which bank is there, maybe they have lots of scabs or are lucky? On other corrective notes it has not been established either way the legal status of bank charges, laws of the land comment made me laugh. Also a business can ask a customer leave to leave their premises whenever they want and without giving a reason. They can also bar them from the premises as well and shut the account down.0 -

LOL@the first comment. I have worked at a bank and I did see guidelines on what you would call "abusive customers" which is where I was coming from. Furthermore, I was looking at whether due to an error by Abbey that interest was charged recently without notice(since it was given in January) which might be related to the previous charge. If it was interrelated to the previous charge, I think you can argue that as the interest was not refunded either then it is a bank error on the current charge. Does that point make sense?
and the OFCOM comment made me smile.0 -
I think I need to go through this with care here,
Thank you very much everyone who has commented, even the negative ones as at 44 yrs old I now know that whilst it's easy to point out other peoples faults, it takes a lot of humility to accept others peoples opinions even if you do not want to hear them. I do and I'm not always right.
I suppose I'm a little biased with banks as I was in debt as a teenager and by the time I finished paying NatWest back the £2000 I owed them, it actually worked out that I gave them £13,000 and all the £11,000 quid was charges.
anyhow, back to now.
My current affairs are thus,
I have an overdraft with them of £500. Hardly a perfect balance but not really worth worrying about. I have to be in a place called Money Way, the former Secure Homes. I got in trouble with the account in xmas 2008 as I bought a PC for my boys when I knew I couldn't afford it, and until now I have been constantly playing catch up with my bills. I wish I had not but thats how it is sometimes.
I currently owe,
£500 on the overdraft and
are paying back err £600 to the Social Fund that I take out each years to tax and MOT the car (this will finish in Nov).
and £300 to Electric and Gas for that spike in prices in 2008.
The rest of my bills are now up to date and I have re-started with Money Way to stop anymore rot to my financial security.
My income IS exactly what I pay out so if you take £45 off me then I have no means of finding that money. I used to joke with my mates about how it would take one parking fine and I would have to give up driving.
The Bank I'm with is LloydsTSB
I had just returned from the Bank when I wrote the first post hence my anger in the lines, I'm also being treated for depression and this probably didn't help.
I have no idea what TighterThanTwoCoatsOfPain is on about, Internet now costs less than a newspaper a day and is hardly a luxury when you have 2 kids who come home with Microsoft Office Homework. I don't drink or smoke. lol, the irony of it all is I have 32 years of computing knowledge and cannot find a job because I taught myself, but thats another story.
I'm going to open a new account tomorrow, Dudley Building Society, one of the few non-shareholder institutions left.
As for not taking bank staffs word, I learn't that one. I would go as far as saying they must tell staff to go out and promote policies that they intend to withdraw to improve charges.
The letter I took in is the first one of the Hardship letters bch_letter1_noint
I hope I have answered all the points but feel free to ask anymore, as I understaqnd it I will have to wait till June 15th to send the next one.
Phil

Crisp £ note You have to go at it again, my first application failed because I was too emabarrassed to tell them [COUGH] everything. You know toilet and the like. But you must, also if you attend a Pain Clinic like I do you should tell your consultant that your Doctor is not being supportive, go to your Doctors and ask them for a copy of what the Doctor sent to the Social. Its your right to view it, they won't want too but you either demand it under 'Data Protection' if its on computer, otherwise under 'freedom of information' if its on paper. This is what I did, they will try NOT to support you because THAT is what the government has told them to do, (truth! the receptionist showed me the letter telling them not to) If you pile pressure on the Doctor he will give in IF you have a valid case. Email me and I'll try to guide you.0 -
P.P.S. I love this site, it has taught me so much about law and yes as pointed out I need to do more reading0

Good Luck MrScabby.
Just one point, is your car essential?? I personally would term a car to be a luxury and as you are borrowing year on year you run it it may not be the best thing for you.
I also presume you are gettinganother form of benefit other than DLA because as i'm sure you know tht is not means tested.MF aim 10th December 2020 :j:eek:MFW 2012 no86 OP 0/20000 -
The car is essential, I have a compression injury in my spine which causes my leg nerves to trap. The more I walk or stand the more I get toothache like pains down my legs. My consultant said, "If you carry anything heavy, then that weight will be transferred into pressure on your leg nerves", hence more pain. The other benefit I get is Income Support0

This may sound strange, but why not pay for 6 months road tax, at best you lose £6 but at best it means that you don't payout one lump sum.
First things first is to reclaim all the charges you have incurred. And not sure any of us need to say about having a good read through the guides0 -
Thanks for the advice on DLA
In your favour I will point out that connection to the internet can be aquired at other places outside the home such as Libraries and Internet Cafe's!
In this day and age of modern technology everyone has the right of the ability to access the internet and its not a luxury to anyone its a necessity to some (I argue most) just like a mobile phone and a Television! Everybody is entitled to a little pleasure in life and each persons idea of luxury is different! Mine as someone pointed out, is having Sky and Broadband, but only because I can afford it at the moment as I dont drink alcohol or smoke or go out anywhere I save by staying in. But if they had to go it would along with the mobile phone, the house telephone the husband, the dogs plus any any other 'unnecessary'. How far does one go?;)Failure is only someone elses judgement.
Without change there would be no butterflies.
If its important to you, you'll find a way - if not, you'll find an excuse ! ~ Easy to say when you take money out of the equation!

Exactly, it does get to the point0

cOk so I have a reply of sorts but Im uncertain how to proceed
They rang me the other day and was asking about my finances. Hmmm I did figure at the time I had no compulsory reason to talk to them but I needed to get across my situation so I told them most of the bad points, ie £300 owed to electricity, £500 to social fund. Needing the car. etc
I received this letter,
Dear Mr *****
Following your recent letter (template letter 1) to our Andover Office and our telephone conversation about Financial Hardship, I would like to confirm the following:
* You asked for help with your charges, I confirmed that the charges were part of the Test case waiver and that this part of your letter would have already been answered by our Andover Office . (They have not answered anything yet)
*We discussed your current financial situation and went through your income & Expenditure details. We also discussed your financial commitments outside of Lloyds TSB. This was to assess you for Financial Hardship and therefors agree the most suitable option to assisst you through this time.
*As mentioned you do not currently meet our criteria for Financial Hardship and because of this we are not able to help you further. I would suggest that you discuss your future requirements with you local branch
I hope you now feel that I've been able to answer all the points you raised with us. Please treat this letter as our final response. This means that if your still unhappy, you can ask the Financial Ombudsman Service to investigate your complaint, so long as you do so in the next six months.
blah blah
Raging is not in it, what do I have to do to qualify??????
Honestly I WOULD BE BETTER OFF IN JAIL, AT LEAST I WOULD GET THREE MEALS A DAY, MORE THAN I GET NOW!!!!!!!!!!!0
