Grounds for Appeal - Contravention Code 27
Comments
-
Hi,
I have been reading the posts from yourself regarding your penalty and I was wondering if you could help me appeal mine.
The ticket was issued @ 1:43am right outside my flat where there are no signs about any parking restrictions at all.. i took a few paragraphs from BogsDollocks suggestion but tbh i don't really understand it, was wondering if you did, please advise..0 -
What does it state that it was for? Contravention code?
And 1.43 a.m.? Who issued it?0 -
My partner received a pcn for parking partly across a dropped kerb at 7.45pm. The dropped kerb is marked with a white line and is in the middle of a residents' parking bay which operates between 8am and 6.30pm Monday to Saturday. She has a residents' parking permit. Do white lines in the middle of a parking bay have any legal standing?0

Yes in areas where dropped kerb PCNs are enforced. Try Googling the name of the Council and 'dropped kerb penalty charge' and then reading the PDF resolution or Traffic Order, or Council website page result where it should explain the basis on which they enforce this.
In the Brighton area where I live a few miles from, they only enforce dropped kerb PCNs on white driveway lines IF the resident has complained. If your Council's website says the same, then as part of your appeal ask for their confirmation that they hold evidence of a specific complaint from the resident. In areas where this is the case, it works OK because people can still park adjacent to their own driveways and allow visitors to park there, without a PCN.
But in some other areas (all London Boroughs for instance) dropped kerb PCNs are issued all the time, no complaint needed from any resident.
There never have to be lines or signs to warn that a Council enforce dropped kerb PCNs so they can be harder to appeal, as there's less to go on.
To get help and comments on your planned appeal letter before you send it, post it in a new topic on pepipoo and ask for advice before you send it off:
http://forums.pepipoo.com/index.php?showforum=30
And show pics of both sides of your PCN (all small print) in your first post there, they do need to check the paperwork for flaws which could win a case for you. Just use a camera if you have no scanner, and read their 'FAQs' on 'how to post pictures' first, plus look at a few other code 27 threads on there for information first. But please do not hijack someone else's thread with a reply like you have inadvertently done here. You need to register and start your own topic with your own pictures & draft appeal letter.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Obviously this raises the spectre that you could be fined for blocking your own drive. A scam the council has learned from PPCs?0

What you don't want to do is prompt the Council, so do not contact them!
But if there's an online system to view the pics taken or make payment, why not try logging on with your PCN number (don't actually pay obviously). Is the PCN number still being accepted as live?
My 6 Months is up and I never heard another word from Newham council since sending in my appeal on this one, my latest fight for justice is with TFL for recieving a Parking ticket for being a licenced taxi sitting in a taxi rank in Southwark street. Im starting to learn that they just issue tickets in the hope you wont take them on. thanks for all the advice :T0 -

You mean a Council PCN? And you mean kerb not curb as we are not in the USA?!
There do not have to be signs up to stop you parking adjacent to a dropped kerb as long as it's either a driveway or a kerb lowered for people with a pram or in a wheelchair to cross over to another dropped kerb on the other side.
But they can only issue a PCN if the Council are in a Special Enforcement area - for instance any London Borough plus some other Councils enforce PCNs at dropped kerbs.
Why not take a photo of both sides of your PCN and put it in a new topic on pepipoo forums? They get most people off most PCNs although dropped kerb ones can be more difficult as there is no need for signs and lines so less to appeal about.
Register, read the FAQs such as 'how to post pictures' then post your topic with pics of the PCN; both sides, all small print except the PCN number and your car reg:

There may be things to appeal on about the PCN itself or whether this was actually a dropped kerb at all. Include pics of the dropped kerb and info as to whether there's a corresponding one on the other side of the road. Or if no pics, post a Google Street View Link to that dropped kerb street view.PRIVATE 'PCN'? DON'T PAY BUT DON'T IGNORE IT (except N.Ireland).

Hi
I hope somebody can help with this. I've just got a parking ticket from Runnymede Council for being "parked in a special enforcement area adjacent to a dropped footway".
I had parked slightly in front of a dropped slope on the pavement. There were no signs, lines, or any other indication of parking restrictions, just a normal suburban road.
I would like to appeal. Does anybody have any suggestions for the grounds for appeal.
Many Thanks
Sushi0
