SE c905 broken again, need rights advice

Hi, I got this phone above as my upgrade in novemeber and as partof it signed upto another 18mths. It broke towards the end of december and because of the festives holidays i was able to get it fixed until after new year. The exact same part has broke again(internal speaker so i cant hear people when speaking to them). I have heard other people also have had this problem and even staff in the shop admit it but they still refuse to let me exchange my phone for another model and also still sell it.

I was wondering what are my rights as i believe it is a wide known fault and basically is an inferior product to the one i extended my contract for.

I would like to either get out of my contract or getting a different model of phone. Another thing is they could even offer me a temp phone while mine is getting fixed so technically i cant use my contract either.

Most networks will only give you a DMR (different model replacement) if they've change the phone 3 times for the same fault (I believe it's in the T&C's). Sorry that's not a lot of help. . .
