Departure and NRP's partner

Hi,

Just some genral advice please.

If a departure is put into effect and your partners earnings are then factored into the assessment what happens if they the leave you? Does the assessment still stand? What proof do you need to supply to evidence the split? Are all sepeartions followed up/investigated by the CSA? When does your assessment revert back to the previous payment?

Sorry lots of questions there but really need to know the answers.

    You need to notify the CSA of a change in circumstances - what proof do you have that your partner no longer lives in the household?

    I dont have any and to be honest i was wondering would they even know if they were or they weren't???!!!???!!!??? Why should they have to pay for a child they have never even met???!!!??? I was just wondering how easy it is to get away with it as the old system sucks and they PWC gets enough as it is. I dont mind paying but fair is fair and at the moment the PWC is having their cake and eating it!

    Think of the children!!! I am paying more than my fair share compared to the bums who dont pay anything and yet the PWC wanst more. She tell the CSA to jump, they reply "how high". All i am asking for is to be assessed fairly and all i am told is wait until 2012 and then you will be assessed like everyone else. NOT HELPFUL COMMENTS!

    Well if it concerns you that much that your wife's wage is taken into account and she hasn't met the child, then don't give her financial details.

    That means that the assessment would be done on your wage alone.

    If you lied (which is what you are asking) and the CSA found out (which would be very easy to do by the criminal compliance team) then you would have committed fraud.

    Your decision if it's worth the risk and the potential future implications (do you really want to have a fraud conviction/caution on your back for the rest of your life? imagine trying to get a credit card, re-mortgage, basic house/car insurance...the list is endless)

    It's like any kind of fraud. Yes there's a chance you can get away with it but there's also a greater chance of being caught.

    Everyone genuinely spearated has proof in some form or another, for example:
    1) If your partner has children, there is evidence of a change from joint to single claim for tax credits.
    2) If your partner leaves, you would apply for a council tax discount.
    3) If you leave and there has never been children with you, both your credit files will show different addresses.

    AFAIK, the csa do not ask for evidence, but the pwc can dispute your claim - if you are proven to be making a false change of circumstances then you will not get the re-assessment, if you are deliberately falsely changing other factors (eg tax credits) to back up your claim then you could end up with a criminal conviction.

    Not quite sure you understand the assessment as you claim your partner is paying for your previous child - your partner is only paying towards own housing costs, which to be fair every adult should.

    What the pwc gets is often debated - to some even £5 is too much to pay, while others think nothing is ever enough. Also it depends on how much the pwc actually receives - some think they are paying for pwc's state benefits, while others think taxpayers should not pay for your offspring.

    Just write to the CSA telling them your partner has left you and you are now living alone & give the date your partner left you.

    When posting the letter, ask the Post Office for a Certificate of Posting and keep it safe. You only need it if the CSA fails to act, or says you didnt tell them about a change of circumstances. If you ever need to go to Trinubal, it will backdate the change of circumstances to the date you give in your letter.

    You can also phone the CSA and tell them when your partner has left you and that should make a record on your case file. Use a skype phone and put the call on a memory stick. Always ask for the name of the person your are speaking to try to say the date and time of the call.

    None, the legislation doesn't say anything about evidence when telling the CSA of a change of circustances. Just tell them in writing what date she left you. It can theoretically be as long ago as you like.

    Trouble is on here, after a time of visiting, you will soon learn that if you are a bloke trying to play fair, you wont get much support.
    Harsh reality is that it is very little to do with supporting the children, it is more about one speices being spiteful and vindictive, sorry to say this there will be many on here who will not be happy until your life is made hell and you so wished you had not found love elsewhere.
    Whilst offering support to those that wish to practice milking the ex male partnerand making their life hell. :(

    I hate that i am being milked by a vindictive person who doesnt care about anyone else but themselves. It disgusting that i have to stoop to the levels of what i am thinking in order to just keep my head above water and keep my house. Will i really get a criminal conviction if i told them we had split up? Can i do anyhting within the legislation to soften the blow? I keep being quoted "just and equitable" but i dont have any children in the house which wont assist me!!! WHAT AM I SUPPOSED TO DO!!!!! I hate the CSA more than life its self and more than that i hate how it seems to gang up on you with the PWC. If anyone has any suggestion i would be so grateful.
