Giving letting agent notice to quit

Hi all

We have recently had problems with our letting agent and decided to give the 2 months notce needed to cancel our contract.
I sent the notice by email to four different people in the office to make sure the email got "through" the system,

Does anyone know if an email is enough?. The notice was sent as part of a previous thread and I have kept the sent email as a record.

    I'd send a letter, preferably recorded delivery - what happens if their email system was 'down' for the day and none of them received this email...

    If I have proof that I sent the emails would that be the same as having the recorded delivery slip.

    no - that's like proof of postage and isn't proof of receipt or of reading. Doesn't the 5 mins of effort and couple of quid postage outweigh the cost of a months rent?

    Something doesn't add up.

    If you are in an AST then you can't just "give" 2 months' notice.
    If you're on a periodic tenancy it's one month (usually from a rent date).

    So which is it?

    Do you have an AST?
    What dates are on it?
    Is it periodic?

    If the agent doesn't sign for the letter then I have no proof of reciept.

    There is also no proof that the notice letter was contained in the envelope.

    I cant just pop in either as I'm 500 miles away at the other end of the country.

    I'm not usually this paranoid but I can't trust a single word that comes out of my LA's mouth.

    Check the T & Cs of your contract with the agent. Might be something about how much notice is needed &/or how it must be delivered.

    Use post, not email.

    Proof of postage should be enough but if you're in doubt send 2 letters, one requiring a signature and one just proof of postage (in case they don't sign).

    Make sure you get the tenants on board. If you don't know them, make a point of meeting, forming a relationship, and making sure they know to send you the rent not the EA! Work out what to do with their deposit - who is it held by?

    Blimey, I didn't think about the tenant sending me the rent money, doesn't that go against the tenants contract with the letting agent.

    Tenant's contract is with YOU. The agent is just that - an agent acting for you. Tenant currently pays YOU via the agent, but if you want paying via a different agent, or direct to yourself, that's your prerogative....
