crisis loan for fees

just wandering if anybody knows what happens with social loans (ie crisis loan from social fund) during bankruptcy,
our cab advisor told us to try and get one if we could not raise the funds through charities or by ourselves.

i sent the paper off last week and have just recieved a letter saying we can have £800 (slightly more than we need for the br fees but a little extra to cover a private debt we have with a local garage who we dont want to inc in our bankruptcy) we will have to pay this back at £8 a week deducted from our jsa.
doesnt sound like much but even this will make things tight each month, even after bankruptcy.
in the paper work i didnt state that the money was for bankruptcy, should i inform them? also i do not know much about how social loans work but im guessing they are exempt from bankruptcy?
im still not altogether happy about getting a loan to pay for the fees,
but we really wanted to get things moving and just cant find the funds from anywhere else.
any advice or experiences would be a great help! thanks

    I see no reason why your crisis loan cannot be included in your bankruptcy, after all you can have DWP as a creditor.
    I shall have a nosey and see if I can find a concrete answer!

    I am a discharged BR and I am still paying money owed by me to social fund( Budgeting loan 6.54/week.Finish February 2010). I did not included this loan in my form but added at the back as additional information.The OR told me that because I had this as a form of loan its included but He CAN NOT force the DWP to actually stop taking the money from my Income Support. He advised me to call DWP and tell them about my BR, but it's up to their discretion to stop taking the repayment . Well I called them after I got discharged . They turned me down flat with the option to dispute their decision but as my OR said previously there is a big-big chance that I will not be able to apply for another social security loan in the future. (I hope I will not be needing it but I do not want to cut the tree out completely from under myself;) ). I just left it to run it's course.
    My advice is to you is to call your DSS office because maybe crisis loan is not the same as budgeting loan.

  • i had budgeting loans going when i went br,(even extended previous loan for br fees) i didnt include on my forms as i was told that you still have to pay them back as they are govenment loans like student loans

    im like single+

    i have always used bugeting loans as a fall back as well and its good to know that its always there for when you need it,

    also i put my current benefit payment excluding the budgeting loan amount being took out. it wasnt questioned why i recieve less than im meant to

    I have a feeling they will not give you a loan if you are going to be using it for BR so I would not mention it to them.

  • yeah thanks tiger i forgot to say i was told not to mention it was for fees as they will refuse so i ticked the other boxes.

    well i wasnt really lying as while im saving for fees i was neglecting other payments

    thanks for all the help! on the forms i just ticked the box that said i wanted it to help towards debts so i'll leave it at that then.
    im confused now! i dont know weaver to accept it, which means we'll go br still owing £800 or keep on trying to save, but we're getting no-where fast with that. atleast they've agreed we can have it so its there if we want it.

    If you need it for the fees take it. How long would you be paying back the £8 per week?

    i think it would be approx 2 years to pay it all back i think, but if my partner gets a job atleast we could pay it off quicker, i know its not that much money, and alot less than we are in debt by now!
    but i would still like to come out of bankruptcy with a clean slate if that makes sence, wont quite feel the same if we still owe money.
    me just being silly probably!!

    I know someone who would qualify for a crisis loan and would be more than happy to pay it back after BR but what would they put on the form as needing in order to get the money as i am guessing that they are not going to wear the fact that you need it to go BR. Can you say you want the money to help on debts or should you put something else?
