landlord causing a fuss

our landlord has decided he wants us out. now all of a sudden he seems to be kicking up a fuss about everything. we found a house really quickly and decided that instead of signing thier 2 month notice letter we had 2 days ago dated the 24th we would send our own 30 day which we are entitled to do so we can move into the other house. our letting agents went really funny and said the letter they sent us was legally binding even though we hadnt signed it. is this true?

    i dont want to pay 2 lots of rent to 2 different landlords i cant afford it. but i havent signed the 2 month notice!! we only had it 2 days ago. how can it be legally binding if ive not signed it?

    The landlords notice isnt legal, its a request, if they want you to move legally they have to aply to the courts for a notice to quit.

    If you are giving a months notice (which is correct if you have a)finished the original term of your tenancy agreement and b)if you pay your rent monthly) it must end on the last day of the rental period to be valid. ie if you pay your rent on the 30th your notice must end on the 29th. you need to do everything correctly as it sounds as though they could be difficult about your deposit. Your landlord doesnt have to go to court to serve you notice to quit but if you don't leave after a valid NTQ has been served he has to apply to the court for a possession order. HTH

    we have fully complyed with the things you say above. and the house is actually better now than when we moved in as we had added extra features which he has appoved and i will going over every room with a fine tooth comb. surely then he cannot possibly try and keep our deposit

    When we were in a house where the landlady put it on the market, we received our 2 month's notice and then a few days later gave our 1 month's notice as we found somewhere else. They can't make you stay and pay an extra month unless you are still in the 6 month period at the start of the tenancy. As chugalug says, everything works on the date you pay your rent, not when the letter is dated.

    Hope you get your deposit back. If you didn't do so this time, when you move into your next place on the day you move in take photos of anything that might be queried when you move out, e.g. stains on the carpet. Then you can prove it wasn't you if necessary later. We spend several days in detailed cleaning when we leave a house, and have never lost any deposit yet... but some landlords see it as bonus money.

    Why on earth would you pay to make his place better? I certainly hope you remember to take the stuff with you when you leave.
