contract taken out under false address

Today had a letter that confirmed a previous tenant has taken out a 24 month mobile phone contract with O2, using our address.
Complicated that the phone is for my stepson, (aged 12) and the ex tenant is my wife' ex partner. Removed by Court Order. Debt problems
as well. Last July 08
However my wife and i were oblivious to this agreement taken out, and are worried by the implications.
Has fraud been carried out?
Should we contact the Police, or O2.

    Yes, please contact o2 and they will shut the account down pending a fraud investigation.

    Yes my stepson does have the contract phone.
    Was only taken out this half term.

    How can a 12 year old pass a credit check then?
    If the contract is invalid (due to his age), how can a fraud have occurred?
    I'm not quite clear who has taken out this contract and on what basis?
    No free lunch, and no free laptop ;)
