    When you receive a package, it is a good idea to write "Contents not checked" on the delivery note, to cover the eventuality that there is something untoward with the contents.
    You are not disputing that you received a package, so whether the delivery was recorded or not is irrelevant.
    What you are saying is that the seller deliberately neglected to send you what you paid them for.
    That is the basis for a dispute, and for involving the police.
    (I'm sure they would much prefer to be out nicking motorists, but you've been diddled and they should help - it's their job!)
  • I bought a pushchair off ebay for over £100 and it never came. The seller just kept giving me duff tracking numbers.

    Ebay couldn't have cared less. Filled in all their forms as you are supposed to be protected and get your money back and never got nowt. I kept emailing and phoning, but they just kept saying you have to wait.

    My daughter is now 2 half and I am still waiting........

    I would rather go to the bank, birmingham is way too busy.

    I remember when I had a life threatening issue and the police rang and asked if it was ok to come the next day at 9 at night! I was like no, I might be dead by then.

    Then there is the time when someone happened again and somone came to my door (Banging the door and stuff), it took 50 mins for the 999 operative to get everything (Kept saying whats the issue, tell me everything lol) and then another 20 mins for the police to come!

    So really CAN NOT be bothered with the police.

    I was just hoping there was a clause or something I could state to get them to budge.

    I paid £65 for the item, it was suppose to be a phone. got a box and by recorded! So I raised a dispute they gave the information and they said send the item lol

    Any ideas? I will send some dead fish from my fish tank or something to them :rotfl: but just dont want to end up having some wannabe chavs at my door acting as if they have a stick up there rear. :rotfl:

    You should name & shame this seller on here & everywhere. Also get their contact info, if this is duff report them to paypal & ebay.

    I have no faith in ebay really, ordered a battery for my camera, paid (as said in stock delivery 2-3 days) 1 week later emailed no response, so after 10days and a 2nd email (no response) filed a complaint with paypal. Suprise suprise thye emailed me saying they were waiting stock - they were still advertising 20 of these & people buying them!!

    Eventually got my money back but ebay were not interested after reporting them as they were still selling the item even though they had no stock. I left neg feedback and the cheek of it they asked me to revise it - no way! I emailed them telling them how appauling they were as sellers.

    Looked a few weeks later & they have load of neg feedback and still selling the item (no stock).

    I can't believe Ebay are getting away with this in this day and age. Surely there is something in law or their own T&C covering fraud? They must have some form of duty of care to users of their service (they are afterall being paid to list items by sellers) and they are raking it in.

    If you buy something from an advert in a newspaper and get ripped off do you sue the newspaper? No its the seller. It works the same in ebay

    if you paid by credit card contact your card company for a chargeback. i always pay for things on my credit card now as paypal are awful!

    Just sue them through the small claims court. Its dead easy to do, I did it when a seller on ebay tried to screw me over for a few hundred quid, but I'd have no hesitation doing it again for anything over the £30 it costs to do it. Shows you're serious.
