Garage Damaged my new car..
I bought a brand new 09 VW in april. A couple of weeks later the paint on the boot started cracking soI took it to the dealership who got a paint expect to come out and examine it. He took some pics sent them off to the VW factory and it turns out the car was damaged in transit and they authorised the repair. Having aknowledged the repair (and a shoddy repair at that) the local dealship agreed to strip the boot back to its undercoat and respray "promising" it would be as good as new (which was to be expected it was after all its supposed to be a new car)
3 weeks later i go to collect my car....
There are chips all over the bonnet and grill (its a fast car so im guessing someone had a good run in her although is just a guess) more importantly the respray job is on the boot is covered in flecks of dust/dirt in it which are very visableeven at a casual glance.
Upon questioning the work ive been told that its impossible to get the boot "factory perfect" and that this was acceptable even citing a warranty guidline booklet. However there is no way on gods good earth i would have signed and accepted the car in this state.
Im unsure what to do next? any help or suggestions much appreciated. Im absolutely gutted about it all

My advice would be don't accept it - take good quality photos and send them to VW head office/paint specialists. Get a profession opinion. Would it be possible to get a new boot lid from the factory - with factory re-spray?
I know someone who and months and months of trouble with a respray after an accident (it had runs/patches/wasn't primed etc). They eventually got the car written off because the paint was so badly done.
You might be able to get a new one with warrenty if it came to it?0 -
not sure what to suggest , but ive been a paint sprayer for years , its certainly possible to paint as nicely as the factory does and quiet easy to do a better job than the factory does
alybea...no you cant get new panels ready painted , although ive seen them swap panels with another car thats the same colour0 -

The thing that worries me is they sold me the car brand new 0 miles on the clock with damaged paint work then there subsequent attempt to repair this resulted in another poor job (albeit not as bad but still unacceptable) so i have very little faith in them being able to repair it.
Ive never had a perfectly new car as of yet....although ive paid 30k for one!0 -

The Sale of Goods Act require the seller of a product, the dealer rather than VW, to ensure several things, probably the most relevant in this case is that it is "of merchantable quality".
In my opinion (and its only that) a £30K new car that comes with botched paintwork which isn't rectified to factory standard when you complain isn't of merchantable quality and you may well be entitled to reject it. They don't have to supply a new car but they do have to give you your money back.
Most co's will start to treat your complaint seriously instead of fobbing you off if TS are involved.0 -
Have you contacted your local Trading Standards Dept (Town Hall Dept)?
The Sale of Goods Act require the seller of a product, the dealer rather than VW, to ensure several things, probably the most relevant in this case is that it is "of merchantable quality".
In my opinion (and its only that) a £30K new car that comes with botched paintwork which isn't rectified to factory standard when you complain isn't of merchantable quality and you may well be entitled to reject it. They don't have to supply a new car but they do have to give you your money back.

I havent done anything yet other than telling the garage im not accepting my car and that i dont see no choice but to reject it... im awaiting a call froma "business manager" tomorrow0 -

Well a girl i know had a new tt after 6 months due to problems she had with the garage..They failed to repai the roof on 3 occasions as it was leaking...They also bumped the car whilst it was in there.
Plus you have more pull as they have admitted it was damaged in transit.
Persevere and you may be supprised0
