Cant give back my timeshare, Help

Diamond resorts will not let me give back my timeshare,it is fully payed for but i cant afford my maintance fee's anymore,and they will not allow me to stop paying it, where do i stand? Help

Someone I know stopped paying her maintenaince fees and they took the TS back in the end and did not persue her for anything. Or you could sell it for the token fee of £1 + the transfer fee on eBay if you really want shot of it.
If you don't pay the maintenaince fee they won't release your week. What does your contract say??
If you want shot of it find a reseller but be careful as some of them are very unscrupulous and will tell you to travel to Spain to see them and they will not be there. Do not part with any cash on the basis that they will sell it - it will be a scam! They obviously ned to pay you. There will be some genuine TS resellers and Diamond should have details of these.0 -
If you cannot afford to pay , then just stop paying. If you lose the Timeshare, big deal, at least you are shut of it. Just bite the bullet I do not think there are many if any prosecutions for not paying maintenance fees.
Be careful if you try to sell there are a lot of sharks out there, seems Timeshare is full of them, surprise, surprise.
Ignore cold calls, these are all scams.
There are more and more appearing on the net, owing to more people trying to get rid of Timeshare. Do not pay any fees up front if asked.
No buyer can guarantee that they have some one lined up to buy your Timeshare, so take with a pince of salt anyone who says they have a buyer waiting. In this day and age not many people want to buy Timeshare.Go on Timeshare Talk Forum plenty of stories there Good Luck0 -

The former company allowed members who had not paid their fees for 18 months or so to relinquish their membership in lieu of the outstanding debt. Those memberships were foreclosed by the management company and the points transferred back to the former developer who was at that time willing to be responsible for the respective delinquent management fees and indeed the future charges payable. However this may not necessarily happen in future and therefore the management company has to take every step they can on behalf of the members to ensure the fees are collected when due and the appropriate action necessary to relieve any outstanding debt.
Have you had a new contract or do you still have one from the 'former company'?
Have you thought about selling the week somewhere like eBay/to friends or family to get the money to pay the fees?0 -

They can only take you to court if they can track you down at your UK address etc.
Ignore all the Threatening letters etc.
There's nothing they can do - Beat you up I doubt it?
Anyway Spanish Law is different to UK law so there are 'Loopholes' in the system.
Tell them that you have been made Unemployed, In fact tell them anything to get rid off them!!
Timeshare gurus are not the most 'Honest' people after all!!

They would say that, as it in their interests to do so. Just call their bluff. If you cannot afford to pay them, thats it . I was in a Holiday Club, but maintenance fees reached a thousand quid a year, so I just stopped paying. Lost membership,but at least have got rid of the expense. If you go on Timeshare Forums there have been lots of threats made, but I have not found anyone who has been taken to court.0 -

Is there a clause in your contract that stipulates that? If the management company has uni-laterally changed the contract to include those terms I don't believe it would be enforceable. But then I am not a solicitor, and I would strongly recommend shelling out for one to examine your contract.0 -
Not all timeshare companies are based in Spain but also have offices in the UK so can chase the debt. This is why I have asked the OP about her contract. If she has no 'new' contract from the new company then the old company allowed people to give their apartments up by not paying their fees. This could be stated in the contract.
What does your contract state OP and did you get a new contract when the new company took over?0 -
