Problems with 3 Mobile

On 21st March 2009 I took out an 18 month contract with 3, which included a Sony Ericsson W890i phone. The radio signal has been really poor on the phone, and this was actually admitted by an advisor from 3 as a known fault with the handset. They have offered me either a Sony Ericsson K660i or W595 which don't match up to the spec of the W890i. Where do I stand legally ?, thanks for any suggestions...davidyng@ntlworld.com.
