car accident this morning, i drove away!

    Sounds to me like one of 2 things happened. Either...

    1. Other driver was being an idiot and caused the accident by pulling in front of you and immediately braking, (not your fault whatsoever).
    2. You pulled out right infront of other driver and they actually swerved around you to avoid an initial accident, (your fault).

    From your description it appears the other driver braked as soon as they got in front of you so that says to me it was the other drivers fault. Be 100% honest with the Police and you have nothing to worry about IMO.

    Hi I appreciate that it could have been a road rage incident, but there was plenty of space after the ambulance had passed as everyone had to do the same as me and move over. I think what he was doing was making the most of the fact that the ambulance was sort of clearing the road for him, as I say he was there one minute and the next he was in front of me. trouble is he had a sprorty gold car and ive got a 17 year honda that handles like a boat (as i've just found out when i swerve), shouldnt make jokes about it all because i feel fed up that I know my car wasnt worth much but now due to someone else actions its ruined.

    You need to notify your insurer immediatly under the terms of your policy.

    Give a full and calm account of events. Be clear that the other driver came up behind you at speed, undertook you and braked suddenly in front of you again. Warehouse is correct with both the above scenarios being possible, just just be clear about your point of view and give as detailed description of the other vehicle and location as you can. Make it clear you want to be contacted if they are.

    Don't worry about the police too much, just be as honest and helpful as possible, get your docs in asap to be clear you want to co-operate and absolutly didn't mean to leave the scene (which they could charge you with). Check to see if you have legal expenses cover with your motor insurance since, if they do charge you, they can help represent you.

    According to the Highway Code:
    286

    If you are involved in a collision which causes damage or injury to any other person, vehicle, animal or property, you MUST
    • stop
    • give your own and the vehicle owner’s name and address, and the registration number of the vehicle, to anyone having reasonable grounds for requiring them
    • if you do not give your name and address at the time of the collision, report it to the police as soon as reasonably practicable, and in any case within 24 hours
    [Law RTA 1988 sect 170]
    Did the other party stop? If they didn't, then there would have been no point in you stopping, so phoning the police within 24 hours would have been the correct thing to do in this case.

    It is a shocking and nervewrecking experience being in any car accident, but one at speed where you loose control like this it is very understandable. Keep calm, remember you have escaped alive and well and move on. If you still feel shaken, consult your GP soon for advise and treatment. Good luck with the police, remember it is their job to be stern!

    just a thought.. but could there be highway cameras that may have picked up the accident happening or at least the other car involved...sorry to hear about your ordeal and also congrats on your house...all the best

    Suggest you report the details of the incident to the police, anyway and give them a description of the car (make model) and see if they are interested in pursuing the driver for careless driving. Slamming brakes on without a reason is, I believe an offense under RTA but without either witnesses, a registration number for the car or some CCTV footage (habve you checked if there is any cameras near the scene) then the police cant serve a S172/NIP on the driver to pursue matters.

    I think its unlikely they can pursue this.

    Edit: re-read you post. i think you have fulfilled your duties under RTA. wonder why the other drivers didnt stop, or pursue you. ifyou were in shock you have reported the incident to the BIB. not sure what the problem is. oh, expect the other party to alledge you failed to stop at an accident to support their insurance claim.
