csa not including child tax credit - when??

    Can I just ask, If I ( the new wife ) am the main earner with 1 dependant child and my husband is taken to the CSA by his ex AGAIN ( School summer holidays are due and she normally wants more money ) Which she wont get anyway, just likes to make our lives a misery, will my income or tax credit for MY child be counted in the assessment ?

    If you are the main earner then no any working tax credits wont count but any child tax credits will.

    Remember you (the new wife) are NOT legally obliged to give the csa your income details if you do not want to.
    Sometimes however, it some cases, it may work out better for you to give your details

    So if a claim went through the CSA now, would it still be CS2 or have CS3 cases begun already?

    It would be cs2. cs3 is due to be phased in between 2010 -2013 i believe but certinally hasnt started as of yet
  • apparently they can take your tax credits and weve been told they can take your childs dla as well how can they do this as they are making me and my child suffer for my partners ex and his children and nobody with any power can back us up except a solicitor which we cannot afford.if anyone knows the law on this please help. this is making me ill

    They CANNOT touch your childs DLA! You may be thinking about the disability and severe disability elements of child tax credits, which they will take into account as it is part of tax credits ( Hubby (nrp) and I have 2 disabled children, so have experienced this first hand!)
    It is morally wrong, but there is nothing you can do about it!

    Unfortunatley this is one of the MAIN injustices of CSA for the NRPS 2 nd family, how CTC can be counted is beyond me, especially when maintenance is not counted for the PWC if they claim CTC and IS/IBJSA.

    Totally unfair and one sided, and something I struggle to comprehend.

    Very true, but if the child and workin tax credit is being claimed in both your names, then this will have to be declared, as it is not just in your name.
  • Do the staff at csa check to see if the nrp and nrpp are getting ctc/wtc or is it just the "jobs worth" that do, i'm sure that many of the staff feel that it is unfair to include the income that comes from the nrp having a second family in the calculation. after all is the csas theory meant to be that the pwc/child/children have the same standard of living had the nrp still been in their household, and if this is the case then the ctc/wtc for the second family would not be there anyway as there would be no second family!!! just seems so unfair to me and many others i know.
