Right to return

Hi not sure if anyone can help my little sis upgraded her mobile yesterday from a sony ericsson to a blackberry she did this in store at the carphone warehouse and she is with orange however she hates it.She went in store today and sked if she could exchange the man was rather rude to her and said no she knew what she was getting and as box had been opened she was not allowed to change is this correct i know it sounds silly but she really does hate it.

    They're right I'm afraid, you have no right to return anything if you've just changed your mind unfortunately. That's not say that they won't do it if you catch them on the right day but they don't have to.

    This is not the case if it was faulty however..... they can't refuse to refund or replace with something else if it's within a reasonable time of purchase (14 to 28 days is generally accepted as reasonable). It is also down to them to prove that it isn't faulty as the product is less than 6 months old.

    As far as I know Orange don't allow 14 day change of mind returns.

    Did she not try out the phone instore before she committed to it?

    Sell the blackberry on ebay as unwanted upgrade and then use the money to buy the phone she wants. :) Problem solved! Blackberry's are fairly popular phones amongst the business types, so I wouldn't imagine it would be hard to shift. Assuming its one of the popular models.
