one question though, the petition for support, needs to be signed under oath , do i just fill in the form and send it with the rest of the paper work and then wait for an appointment to sign it under oath or do i take it in person and sign it there and then?
I took my affidavit to to the local magistrates' court and swore it at the public counter, they didn't charge me anything, then I went and had it copied before going back to submit it and pay the £40 REMO fee.[/QUOTE]
thanks hun , think i will do that, i did not realise there was a fee, but i do nowand the times i have read these posts, I think tiredness is takign it toll.
I have a feeling i will get the ball rolling and he will move state again0 -
Thank goodness to have found some other people going through the REMO experience at last!
I've been dealing with REMO off and on for a number of years and it seems to me that the whole process needs to be made a lot easier, quicker, user friendly and more supportive. I bet loads of people just give up!
I'm thinking of writing to the DWP who are consulting on a Green Paper (comments in by 7th April 2011) in order to try to get this whole area looked at, as there must be an ever increasing number of people caught up in reciprocal enforcement. What do you think?
Plus a support group for advice and support for those going through the process would be great. Something like you guys have started doing on here!
Hi again,
I haven't used these forums before and don't know about how you are supposed to use them. Sorry if I'm not doing it the right way!
The DWP Green Paper, I mentioned - they are consulting at the moment. It is called 'Strengthening families, promoting parental responsibility: the future of child maintenance - public consultation' Replies have to be in by 7/04/11.
I'm sure we are all in agreement that the current system re enforcement of maintenance overseas needs changes. Surely a group of people all saying much the same things are going to be listened to far more than individuals. There must be loads of us affected by this issue. Don't we need to get together and start doing some lobbying?0 -
So my latest update is that i have faxed directly the lady that appeared on the last letter we received ( last week), providing her with NRP address, SSN and latest employment details. I have also let Liverpool know that i have done this. I intend on calling the customer service number friday if i cant get hold of this lady at her desk, to make sure they have at least sent the notice of support to him.
I spoke to him saturday ( begrudgingly) and he reckons he will be back in work this week or next and be able to start paying me child support. All very well and good but dont think he will when he gets the notice.I am continuing with REMO as he needs motivation to stay in a job or if he leaves to find a new one quickly....0 -
Hello everyone,
I am been reading your posts for the last hour or so and I would like some help and advice please!!!!!!
I am divorced and I have a Residency Order for my daughter who is 8. Child Maintenance was never part of my divorce proceedings because I have always obtained maintenance from my ex husband through the Child Support Agency. My ex-husband works in Hungary but was being paid through a UK firm so Child Maintenance was always straight forward by using the CSA.
I have just received a phonecall from CSA informing me that my Ex-husbands situation has changed and he is no longer being paid from the UK and his firm will be paying him from Hungary. Therefore CSA has no law covering them to obtain payment!!!!! I have looked at my Bank Account and my ex has not paid maintenance for the last 2 months.
I rang REMO but they were very unhelpful and told me to go to my local court. I rang Oxford Magistrates Court and they told me that they are closing but send them a letter with all the details and they will forward it on to the appropriate department.
After reading all the posts I have started to panic and don't really know what I should do. Please can anyone help me and point me in the right direction....
Any advice is welcome.
Thanks0 -
Hi Zoemands you need to get in touch with yoru magistrates court, and speak to someone in the family, maintenance section, depending on your court will depend on how experienced they are at dealign with Remo cases, and ask for the forms for Reciprocol enforcement of maintenance order.0
-
ooh quick question, i have finally filled out my forms has taken me a total of 2 and half hours this evenign to finish them off, i have put in with them all that they ask, except for my latest loan/credit card statement as i cannot find it, but I have the evidence on my bank statments of the amoutn goign out - do you think this will be sufficient?
I want to take the papers to the court tomorrow so that it is one more thing out of the way.0 -
well i handed in the paper work, - i had no fee as they said they do so few they dont charge, so one happy customer here, now it is just back and play the waiting game i think0

Hi Knit, you wouldn't be charged for a REMO application. Its always free.
Zoe - you are where I was almost 3 years ago! Learn from my mistake though. That was, I didn't have child support attached to my divorce court (ancillary relief) papers. I was told my Oxford Mag's court that the reciprocal counrtry would arrange for an order when one doesn't exist.
Wrong!
You need to read back through this thread to post 141. Here you have the exact information you need to follow through with now. You will need to establish a court order here, do NOT RELY ON THE RICIPROCAL COUNTRY TO DO THIS FOR YOU. I wish I'd know that when I was starting out. But, as REMO's are not all that common, it seems highly unlikely you'll get anyone at the local magistrates courts that actually know what they are talking about, and unfortunately, you can't by-pass them and go directly to London REMO (I've tried)
Have you tried talking to the father to see if he will continue to pay you direct?0 -

You do if your consent order was made in a county court rather than the magistrates. My first application was rejected by the judge cos I'd followed the procedure for a magistrates issued order.
Ex has started paying again with a $100 overpayment, but probably because he should've been contacted in the US by now.0 -
Well NRP has phoned and let me know he has had his first letter ( from attorney general??) and to give me the guilt trip from hell. Wanted to let me know he would probably now lose his licence and car registration and how was he supposed to pay for representation at the court hearing...
So who do i need to contact now?? Customer services? Do i wait til hes served???
Hmmm long slog ahead.....0
