I have to agree with most of you that Breeze should have sent the swimsuit back sooner but I also think that if figleaves have the smaller size in stock they should have exchanged it.

Although I have never been in this situation I would also be annoyed that I could not have an exchange or credit note. I think that its a companies choice of they bend the rules every now and then and I think it would show good customer service to have done so in this case.

    Just my thoughts....

I am confused ... why exactly should the OP get a credit note .... there was nothing wrong with the item? The OP bought something, held on to it for more than the generous return time & then wants a credit note ... where exactly do the company draw the line - 6 months, a year??

Agreed - there is a returns policy, OP has missed it.

DSR? Could've been used (though company T&C's may purposely exclude swimwear and underwear - leave that arguement for another day) BUT I thought the DSR states returns have to be made within 7d, so in this case - Irrelevant.

    So, to conclude........

Retailer has gone beyond the statutory requirement and offered /quoted a 14d return policy - i.e. 100% increase on the statutory.
OP has not managed to comply with the above
Retailer is not obliged to do anything more (oh but they could choose to charge you to return the swimsuit to you) - it could be classed as petty as they could as easily return the next size down but that leaves them with a used swimsuit on their hands.
    End of.....
