Figleaves refusing credit note

I bought a swimsuit online from Figleaves.com. It was too big and so I sent it back. Unfortunately I didn't realise they had a 14 days return policy instead of 28. They said they didn't receive it within the 14 days which I accepted and have refused me a refund. I then asked for a credit note and again they refused. They have also refused to send me a replacement swimsuit. I have been told that the one that I sent back can either be returned to me or if they don't hear back they will destory it!!!! Apart from an absolute waste of a perfectly good swimsuit, I fail to understand why they won't replace it or give me a credit note. I am absolutely appalled at this and will definitely never use them again. I have never come across this before with any other companies, are they within their rights to be able to do this? So much for customer service and goodwill in the current climate! Any input would be gratefully received.

Did you notify them beforehand that you wanted to return the item? If you let them know 7 days after receipt of the swimsuit (by letter or email) then they have to refund you under distance selling regulations but other than that I don't really know what the legalities are with what they are offering you.0

What Ivory Tinkler said is correct however if their own terms say you have 14 days then you have 14 days but if it took you longer (and it sounds like it did) then legally you have no rights at all.
I know it's annoying but maybe you'll just have to put it down to experience?:heart: Think happy & you'll be happy :heart:

Thanks for your comments. I don't buy many things online so wasn't aware of the 7 day policy. I take responsibility that I didn't get it back in time but I just don't understand why they won't send me a smaller one. It didn't cost a lot of money but it just seems so wasteful to destroy one that was simply too big. I have learnt my lesson and although they appear to be within their rights it just doesn't make any sense to me and I won't be shopping with them again. Thanks again for the input.0

Some stores have a hygeine policy on swimsuits too,they wont refund them if you change your mind.I do think 14 days is adequate and their t & cs were stated,you only have yourself to blame.They have to be consistant.

Having said that, in this instance, they are not in breach of the DSR since the 14 days thing covers it, and if they won't have a more generous policy that's their choice, and yours to use them or not when you read their terms.0 -
I would also get it back and sell it on ebay/car boot. Don't let your money be wasted completely.
OP - it's not always 7 days. That is just the bare minimum they have to offer you by law. Some other companies offer longer. I'm sure with Next you get 28 days, or you used to. It's just always best to check their returns policy before you buy something.:heart: Think happy & you'll be happy :heart:
