    This company is awful and think themselves above the uk law. From the lying, rude shop staff to the waste of space customer service (india). It is supposedly up to the disgression of the store manager as to whether I get a refund and he said it is 3 company policy that you cannot get a refund nor can I now exchange because its gone past 28 days.

    My only option now is to take them to small claims which will cost me a fortune or I just forget and lose out on £100 and put it down to experience. It is a disgrace that big companies can deal with the public like this and get away with it.

    Yes the company are rubbish and you haven't got the answer you wanted, but as they are offering something reasonably valid (repair) then why not give it a go and see if it fixes the problem. Obv if it is a known fault then chances are it won't but it would at least put you in a stronger position having attempted a repair to then go for replacement further down the line.

    This of course is all good in theory but as you've found 3 don't give a hoot about any of this so the moral of the story is, don't buy anything from 3!!

    Yes I have found that out the hard way unfortunately.

    But as according to their policy and 28 days has passed then I cannot even have the phone sent for repair! I cant have an exchange and most definately cannot have a refund.

    What these places seem to forget is that their policy does not override the law, so it may be worth reminding them of their place in the food chain and that as much as they may want it to, the law of 3 mobile does not sit higher than our trusty Sale of Goods Act legislation. Their stupid little policies do not change the facts that you are entitled to a repair/replacement/refund in the relevant situations.

    I do despair at these companies, as you may have guessed but working in consumer advice for a number of years does turn you that way unfortunately.

    As you sort of mentioned before, have a look on the Consumer Direct / Trading Standards websites and try and print something off to back up what you're trying to say. You could also mention that the lovely people at CD would be more than honoured to give them a refresher in consumer law as it seems they must have missed it out of their staff training :D
