Hi, I purchased a handset from a local three store, but it has become faulty.
I took it back to get a refund and was told it is their policy that I could only have it repaired or exchange it for another one.
I said this was wrong and that under the sales of goods act I am entitled to a refund.
Am I right?

They are right, you are entitled to a repair (within a reasonable amount of time) or a replacement, then if neither of these two options are possible, THEN you can have a refund.Should've = Should HAVE (not 'of')

Nope, it's down to the supplier, you can only request a refund when all other avenues have been exhausted...If it looks like a duck, and quacks like a duck, we have at least to consider the possibility that we have a small aquatic bird of the family anatidae on our hands

According to the consumer direct website this is what it says -
If you have only had the phone a few weeks or haven’t had a reasonable opportunity to check it, you are probably entitled to a refund for a fault or poor description, or alternatively you may request a replacement.
So that implies I am right0 -
OK, if we are going to be pedantic about it, the very next line on consumer direct says:
"If the fault is only minor and can easily be put right, it is reasonable to accept a repair. This won’t stop you claiming a replacement or refund if the repair turns out to be unsatisfactory."
and then goes on to say:
"If you have had the phone longer than a few weeks or have had a reasonable opportunity to check it, you are probably still entitled to a repair or replacement. A repair should be carried out within a reasonable period of time and without causing you significant inconvenience."
SO it all depends on a) how long you've had the phone and b) what the fault is

Not trying to be pedantic, I was just stating what it said on the consumer direct website.
My phone I have had for 15 days, it keeps turning itself off a lot of times.
I only used it once when I got it to top it up with the voucher from 3.0 -
It relates to the concept of rejection. If you have accepted the goods (through conduct or passage of time) then you lose the right to a refund.
Essentially, this all depends on how long you have had it and whether the defect is so serious as for it to be reasonable to reject.0 -

I posted that info in the thread above. Having had a chance to look on the net, I have now seen this is a known fault with this model!0
