Three payg faulty phone

Hi, I purchased a handset from a local three store, but it has become faulty.

I took it back to get a refund and was told it is their policy that I could only have it repaired or exchange it for another one.

I said this was wrong and that under the sales of goods act I am entitled to a refund.

Am I right?

    You are only entitled to a refund if you have not used the handset and have returned it within 2/3 days of ownership. You don't say how long you've had the phone before it became faulty. I think Three are correct to offer a repair or exchange in this instance. You can't use the sales of goods act as the phone was new and functional at the time of purchase.

    I have only had it 15 days and the phone switches off all the time and the only time it was used was to top it up with the voucher given to me by 3, i must also add it is within 3's 28 day return policy

    Nope...you are wrong.
    You can only get a refund after the repair route has been exhausted or they cannot offer an exchange.

    this is lifted from consumer direct website -

    If you have only had the phone a few weeks or haven’t had a reasonable opportunity to check it, you are probably entitled to a refund for a fault or poor description, or alternatively you may request a replacement.

    So it sounds like I am within my rights to ask for a refund first.

    I just wanted to highlight the probably and not a must.

    Where did you read about 3's 28 days return policy? I've only ever known them to have 2/3 days if bought from a shop, or 14 days for telephone and online orders. All of which says you are entitled to a refund if the handset or sim has not been used. Otherwise they will repair or exchange the handset.

    If the phone keeps switching off, it could be a battery issue. But other than that, I don't really know.

    Exactly.
    Probably does not mean 'will be'.
    Very few companies (if any) would replace and i doubt if any at all would refund.
