    ask for a face to face interview with a HB adviser, take all the paperwork inc wage slips and every letter from BR, you can see the HB dilemma, you at present have (in theory) a share in a house, so you have to sort that, a voluntary repo will (probably) result in a shortfall which will push you nearer BR, why not just go BR asap and hand the keys into the lender. job done

    Spoke to shelter & the council...BR is not proof of not having a house as an asset....their words!!!!

    We have given all our documents into the council and they told us we cant continue with the claim until proof recieved,,,

    Wont backdate to our original date as its over the amount of time allowed for us to get proof.

    Letter from OR will not prove anything as we will still have the house in our name..

    We have started the volu reppo in the hope of some speed...

    It is catch 22 ...... we are paying our rent out of the wftc & job seekers.....& my little bit of earnings....

    So we are a bit stuck ....

    Hence hold onto the BR money and try to get proof of non house owner asap .....then go BR

    Yep - hold onto the BR money. With a daft council like that, it sounds as if you will need the funds to eat.

    I hope that your mortgage company is nicer than the council.

    Unfortunately (or fortunately for some people) that is very true - with so many houses in negative equity, bankruptcy doesn't automatically mean you have no house as an asset. However, I don't see how they could argue with a letter from the OR stating that they own the beneficial interest in the property :confused:

    Definitely has to be worthwhile speaking to your local councillor surely?

    Just phoned the council again .... they want to see all related paperword ref mortg arrears ....

    They did mention neg equity (not been mentioned before) as this would prove there is no asset in the house.....

    Maybe there is a chance there...going to pop down today with all the paperwork again!

    See where we get .....

    Im so fed up that we have paid so much into this country and now we cant get the bloody help when we need it .... but thats a whole different thread lol

    Ok just been into the council & this is the position....

    They will only accept full reppossesion notification not aknowlegement or cout dates or anything else......that could take months.....

    They are not sure about an OR letter.........whether that would suffice is still an un answered question!!!!!

    How long after declaring BR would we be able to get a letter that states that we have no benificial interest in the house????

    Surely that would be proof enough to show them we dont own the house????

    1/2 of our total income each month is going on rent, we cant pay the CT or provide proper food and essentials for our family....

    This is crazy !!!!

    The council CAN make discretionary payments for housing. But this is something that a professional will have to help with - CAB/Shelter. Or perhaps the benefits board - be prepared for them not to be so nice. That board attracts a particular kind of troll.

    Only a thought, I may be wrong etc etc but could someone like Welfare Rights or an advocacy service be of any use to you in negotiating between yourselves and the council?

    Actually, that isn't probably useful but thought to mention it.
    Any help, opinions, views I may hold those are my own. Respect them as you would expect the same in return. Offered freely, is gleaned from a lifetime of experiences, knowledge gaining. Passed on to benefit others. I may be direct, ask you questions but those are to help you. Up to you if you choose to take it. I won't judge you either way.
