Well today didnt go to plan as we were expecting a deposit that didnt clear in time.....

However

Thinking about it .....we have decided this...

Bancruptcy wont change our financial position at the moment...

We need help with the rent for the new rented house we are already in first and formost - we will only get this if we have a repossesion letter....

We have called the mortg comp today and advised them that we cant keep the house....they are sending the volu reppo letters out today

Seeing as we are not BR does it really matter if we sign to accept the shortfall?

Once we have done this and let them have the house back we will then have proof for the council to help us with our new rent ....

We then go BR.... the shortfall would then be included anyway as this would be an unsecured looming debt .....as long as we mention it on the forms this should be included?

Have we got this all right????

Thx guys ...... oooh the ups & downs of life eh !

If you go for voluntary repo on your house, the council are under no obligation to rehouse you.

As the post advises we are in our new rented house!

    We dont need re-housing .....

We need help with the rent .... we need a reppo letter to enable us to qualify for housing benefit....we cant get HB as the house is seen as an asset
  • What i would do

    1. secure somewhere to live as renting somewhere after bankruptcy is harder

2.Joint debts will go to ex their problem not yours

3.Forget your house walk away let lender sort it out . Add short fall to bankrutcy

4.Stop paying debts to raise fees and bond if you need to .

    5. Go bankrupt

    6. A debt free life

    Thats what we are doing/done:

    Left house.

Rented new house already in it & renting it

Havnt paid any debts since Feb

Need a repossesion letter asap to enable HB

We need to push this reppo along to get the proof.....

Then go BR ....as the BR will not make any difference to us at the moment...

I am asking for advice on shortfall ....not housing....that is sorted out as per original post....

    LOL!

Your new plan! If BR is not going to make a difference really (a bit like me, creditors couldn't contact me and I wasn't paying anything anyway) then sort out what needs sorting first - dump that old property (not the OH ... lol) and sort out your new home ASAP; I agree that your new one is far more important.
  • sorry i typed reply on wrong thread wonder where it had go lol
  • I concur with Skylight. Get yourself sorted first before you go bankrupt.
