If you get a listing pulled once you cannot relist them again even if you know they are genuine. Thats why you have been suspended. Did the first time mention vero? You need to get in touch with the vero holder and ask why you cannot sell your 2nd hand purchase. Just make it clear you are not a business seller.

In the meantime try gumtree and local free adds to sell them.

Email or call ebay and explain, then ask if there's a way to get it lifted.

Was Vero mentioned on the email ? The other thought here is that you have been caught under the adult fetish rule..used shoes anyone?

Many sellers have seen the prices achieved in the adult market where ladies (or even men sometimes) sell old shoes and have decided to try it themselves. However selling to the fetish market is against ebay rules and sometimes genuine sellers of second hand goods get mass reported by vigilante who just search for used sandals or such like..and that may have happened to you.

It is a difficult one to appeal as of course the ladies who do sell in this market try to look legit, they make all sorts of claims about genuinely selling these items as there is still a lot of wear in them (etc) and you may well have genuinely used some of the terms that they use.

If you have been cuaght under that the email should mention listings not allowed by ebay, and you could maybe email them and explain that you listed these genuinely and will not relist, and they might then remove the suspension.

Please though be very careful about selling used shoes, whilst so many people see it as a way of making lots of money (we have threads on here and some people on MSE do it) it does impact on genuine sellers.

7 days is not the end of the world, I'd sit it out and be careful from now on.

It might be worth opening a new account (once the suspended on is up again) and using that from now on.

The birkenstock sandals were just old ones. They mentioned this

Your eBay account is suspended for at least seven days for breaching our policy.

Trademark infringement is unlawful and breaches eBay's policies. A trademark is a unique sign (such as a name, word, phrase, logo, or symbol) that a company uses to identify its products and/or services.

Using another company's trademark in a way that may confuse buyers about the source of goods or services, or confuses buyers into believing that the seller is affiliated with, sponsored by or endorsed by the trademark owner is both illegal and against eBay's policies. Examples include counterfeits, unauthorised replica items and items that bear the brand or logo of a company without that company's permission.

Guideline: If the product you are listing bears the brand or logo of a company, but it wasn't made or authorised by that company, don't sell it on eBay. It's against the law to sell unauthorised replicas of brand name products. Accordingly, listings for unauthorised replicas are not permitted on eBay.
where did I go wrong? Is is NOT fake

Are you absolutely, 100% sure they are genuine as there are fakes around?

Are they the ones that you bought from the car boot and posted about on the other thread?

Are you sure that Birkenstock allow their goods to be sold on eBay? Second hand or otherwise?

Many fashion companies will only allow certain retailers to sell their goods, and quite a few specifically state that they are not be to be sold on eBay. If the manufacturer (or a scanning agent employed to search for them) sees a listing for the product, they will request that eBay remove the item. eBay are legally obliged to comply with such requests.

As above, try your local paper or Gumtree, but be cautious that gumtree is developing a "black hat" reputation - lots of people are now using that to pass off goods that they would not be allowed to on eBay, even though they are one and the same company!
