Ebay item - misleading description - Help!

I bought a camera from a private seller on Ebay. Having received the item I am most dissappointed as I feel the description is misleading. Here are the facts
1. The photographs shown in the listing are the same model camera but not the actual item I bought - it doesn't state this in the listing and I (rightly or wrongly) believed what I saw was what I was getting.
2. The textual description makes no mention of the extensive scratches and wear to body and shutter - the buyer says the fact that it is listed as used is adequate.
3. The item is described as a recent purchase/unwanted gift (Feb) and is being sold as he already has another camera - it looks considerably older/well worn.
4. I have contacted the seller, asking for a full refund saying the description was misleading but he refuses, saying he only gives refunds if the item is faulty.
What should I do?
Regards
Tom

I think I would be opening a Paypal Dispute (asuming you paid by paypal) for item not as described.0

I suspect item descriptions are the biggest cause of disputes on Ebay with some sellers being frugal with the truth. The description for this particular item is so flaky I suspect it was a deliberate attempt to put 'lipstick on a pig'.
I will keep you posted on my progress in this dispute.0 -
As mentioned open a dispute, you will have to send it back, make sure you send it at least recorded.
As a seller a spend more time listing defects than good points, in most cases people say things where better than they thought they would be so no problems.Have my first business premises (+4th business) 01/11/2017

I have just won the claim with PayPal.
The seller now wants to cancel the ebay transaction. Do I have to? is there any option? I want to give this person the feedback they deserve for all ebayers to see. If I am obliged to cancel he will get away from the negative feedback I am about to give him.
Any advice?0 -
lol classic poor/dodgy seller tactic
you are not obliged to cancel and i wouldnt in your shoes0 -
I thought you could still leave negative feedback even if you agree to the seller's request to cancel the transaction? The seller wants the commission refunded.
Presuming you returned the item for a full refund, did the seller pay your return postage? If they didn't I wouldn't consider their request.0 -

Are you sure about this? Can you still leave feedback if you as the buyer receive a NPB strike? Either way as far as ebay is conerned there has been no transaction (or it was cancelled) so surely any feedback would be too.
I'd like some clarification on this for sure. Soolin perhaps, can you fill us in please?0 -
A seller should not open an NPB on a buyer who has paid and been refunded. If a seller does that the buyer should immediately inform ebay and supply the original paypal transaction number and have the strike removed and a warning placed on sellers account.
There is nothing to stop a seller requesting a mutual cancellation which a buyer can refuse or accept at will. However accepting the mutual does not mean that the buyer cannot leave feedback.
The only time a buyer cannot leave feedback is where a full NPB is opened against them and the buyer does not respond.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards. This may be an unusual scenario and also a silly question, but if the buyer responds (perhaps to say they paid via cheque or something) but does not have a valid paypal transaction number and therefore looses the NPB dispute, would I be correct in thinking that they cannot leave feedback and any feedback they had left would be removed?
Thanks for taking the time to clarify the above.0 -

As soon as a buyer responds in any way to an NPB dispute through the dispute console they retain the right to leave feedback. Even if th ebuyer loses the nPB dispute they can still leave feedback.
It is complicated further by there being some categoires of feedback that may be removed by ebay if the seller appeals after a full NPB dispute has been completed but where the buyer has responded.I’m a Forum Ambassador and I support the Forum Team on the eBay, Auctions, Car Boot & Jumble Sales, Boost Your Income, Praise, Vents & Warnings, Overseas Holidays & Travel Planning , UK Holidays, Days Out & Entertainments boards.
