Can I change my phone? T-MOBILE

I upgraded my phone last monday after being recommended by the assistant I got a Nokia, I was fed up with it by tuesday, as I have always used a Sony Ericcsson.
I went into the shop on wednesday & asked if I could change it, the assistant said no.
I rang 150 & the girl said if i had bought it on the net, I would have 7 days to change my mind but didn't know what shops did.
Am i in a position to ask for an exchange of phone, its a grey area to me as I know i saw the phone but didn't have a chance to use it until I left the shop.

What are my rights? as tomorrow will be 7 days up

Anyone help?

    You have no rights to return a working product if you bought it in a shop.
  • The 7 day exchange policy is due to the Distance Selling Regulations, so if you got the phone on the website or from their Telesales department, then you would be able to return it within 7 days. As you got it from the store, this won't apply.

    The only other way you could possibly do it would be to cancel the contract within 7 days due to poor network coverage within your house, and then leave it a couple of days and take out a brand new contract with a phone you actually like. But you would have to make sure it's one you will keep, as they would probably end up catching on eventually.

    ^it sounds like she is an existing customer upgrading, so canceling under no coverage probably wouldn't work if they have been using their old phone quite happily for the last 12/18/24 months

    You can't return it, as they are unable to sell that phone as new once you have activated it and can only put it back into circulation as a refurb.
    No free lunch, and no free laptop ;)

    sell it on ebay and use the cash to buy the one you want.
