If the right is not backed by law then it cannot be enforced, so it is worthless.

exactly and the same law protects us against lenders that think they can ring and harass us to pay them every penny we have! Ermmm, that backfired ....

planet earth my son, planet earth

On planet earth, we don't need laws written just so we can request people to do things.

Aside from the slanging match this seems to have derailed into, the answer to the OPs question is yes, they can do this.

Any arrangement they offer is concession, which they are not obliged to provide, therefore they will offer it in line with their own policies, and cancelling luxury payments usually comes under such policies. Whether you disagree or not, or whether the you do not like banks or not, they are within their rights to decline his arrangement offer if he is paying for items like £60+ to Sky TV.

If MBNA want the OP to pay them instead of Sky then they have a legal route to enforce that.

This route is not having a junior CSA making degrading remarks over the phone which leave the debtor feeling inferior.

So, you'd rather CC companies didn't attempt to negotiate and instead went straight to the legal route?

you'll find that in this day and age you actually do! Put it this way, give me a parking ticket and i'll go off and search records to check you applied for the right licence; that the sign in the correct height/depth/planning order and when i'm finished bet you find I dont pay the parking fine.

You know why? cos everyone makes mistakes and unless they have a contract in place to protect themselves then they deserve any action taken against them.

the lenders issued incorrect CCA for years thinking we were daft - now we've challenged this and have noticed the lenders panic somewhat!

My point is that legal documents protect assets - not a tenner a month from a repayment plan off average Mr Bloggs!

No they cannot do this as already mentioned. Please get your facts right. They are perfectly entitled to ask him to give sky up, and the OP is well within his rights to laugh and hang up on them!

The exception to this would be if the lender issued default/ccj proceedings in which case a supplementary offer of £10 per month will result in these applications being thrown out.

Unless of course you want to tell me otherwise?

You're talking irrelevant nonsense. Negotiating an arrangement and enforcing a legal settlement are two different things. Most sensible people prefer to do the former before the latter becomes necessary.

My opinion on this is not relevant. It is the way the system works that is important. Lets stick to facts and not opinions.

Fact is that MBNA can ask the OP to cancel their Sky subscription but they cannot force them to do this without following legal procedures which involve court proceedings.
