  • Yes I agree with your conclusion of CSA policy - Screw the Honest and don't worry about the sly and the liars cos they are a bit time consuming.......

    I have been advised to apply for a variation (a dangling carrot of a glimmer of hope) but then subsequently been advised that its probably best not to because he could just say he got the money from anywhere ie dad, girlfriend and that "nobody ever wins variation claims".

    I have been told this week that "criminal compliance" is now an angle I can use....does anyone know if this is another toothless dog or actually worth bothering with?

    My case has been with criminal compliance in the past.

    They have some pretty wide reaching powers.

    In my case they were able to obtain all of my ex's bank account activity going back several years.His assessment then changed from £5 per week to £850 ish per month.It did take a long time - 2 1/2 years to do the investigation however this was some time ago and my understanding is that criminal compliance have improved since then (2007).

    It was definitely worth my case going to criminal compliance, trouble is with variations that they are nearly always turned down, then you have to appeal the decision, then if you ask for and attend a tribunal, the burden of proof is on you to prove the NRP's income is at odds with their declared income. That is my understanding of the process anyway, I'm sure someone with more knowledge will correct me if I'm wrong!

    It is accepted at very high levels that the 'Burden of Proof' has been removed from the CSA and placed on the NRP they are guilty untill proved inocent!

    Yes the CCT are a good thing but they looked in to my ex who is the PWC and came up with nothing! If thier findings were correct please can someone tell me just how when she was on JSA she could afford to take 2 kids on hols to the Med in the summer and skying in the winter, and afford a new car as well as eat out in reastruants when the kids were with me? Is JSA that good if so then I have got to get on it as I can't afford half of that!
