Should I complain......again?

Currently, my case is with legal enforcement, (M.P helped get it there).I'm the PWC. CSA applied for committal order in January 09, still waiting for court date.

NRP is high earner, self employed, LTD companies, spends time on/off JSA, L.O against him is for £24k, total debt is £35k. NRP came off dole again in January, I noticed my £5 per week had stopped.£5 per week when on benefits is the only money that has ever been paid.I work, no benefits..... before you say! :wink:

In mid February, legal enforcement team said they would refer NRP for reassessment, it would take 6 weeks.

Last week they said it had not been done, file lost, another 6 weeks wait. They said further, that the assessment would be £50, default amount for three children, ex has not responded to any MEF's or letters. Also, when reassessment done, the file would go back to criminal compliance - third time now.

Last time criminal compliance took two and a half years to investigate, findings amended assessment from £5 per week to £900ish per month.NRP paid nothing, appealed and lost, claimed JSA. The criminal compliance findings also showed that JSA was claimed in the past whilst NRP's income was £2k per week.

Should I complain again about the lost file and the time taken for reassessment?
Everything is delayed again, by the time criminal compliance finish and find that his income is £100k per annum again he'll be back on JSA.

Ordinarily, I would have complained straight away but I just did not have the battle left in me at the time. Feeling a bit more indignant today!

    Hi koolmummy, that is awful.

    So unfair that they are allowed to get away with it. Does your ex have any kind of relationship with your children?

    I hope that the CSA will be taken over by the Inland Revenue at some point as then the money would automatically be taken and none of these delays and missed files etc could happen.

    I'm astonished I can do this Kellogs, thanks for that. Last time I tried to argue that JSA was being claimed to evade CSA, CSA said that all I could do was notify fraud hotline that his claim could be fraudulent. They were quite definite that I could not appeal if JSA was being claimed.

    My ex sees the two youngest, he manages about two hours every other Saturday. Will not commit to more as he's not allowed to bring his new wife - for complicated and lengthy legal reasons, basically she's mad!

    I'm interested to hear that you can do that too as the CSA just tell me the same - ring the fraud hotline....

    My ex has resigned every time the CSA catch up with him. They say that they can't even contact him at the moment as he doesn't answer his mobile number and they have never been able to verify his home address (I have given it to them but that isn't good enough).

    I've had enough of playing missus nice guy - I still let him see the kids (when he can be bothered) and never bad mouth him. The kids absolutely adore him........very hard to bite my tongue sometimes!

    I went on google the other day to see if there was an alternative to the CSA - ie an agency who will go and speak to errant fathers and try and talk some sense into them. Tragically didn't find anything but did find a site that offered advice to people trying to dodge the csa..... grrrrrr

    I think the worse thing is that if all our ex's dodge the system long enough then once the child leaves education the debt disappears - it should remain as a debt otherwise it is almost like the reward they get for being evasive and having no morals, conscience or idea of parental responsibilities.

    If you can show that one of the reasons for him giving up his job was to avoid CSA then you have a case - it is clearly written in the legislation to supposedly prevent such things from happening. You need to appeal ASAP - if it is within the 13 months of the assessment, do it late and state that you were told that you had no grounds to appeal and state what they said, and then subsequently found that the legilsation allowed for deprivation of income cases to be heard.

The debt remains until it is paid - my daughter is now 20 and I got the money the year before last when the case had been closed due to her no longer bing a qualifying child. - it should remain as a debt otherwise it is almost like the reward they get for being evasive and having no morals, conscience or idea of parental responsibilities.

    so they will still pursue him for the debt even once both children have left full time education? WOW was I misinformed! I was told the debt stops existing once they leave school.

    If someone does not want to pay, they are not going to pay. The thing is, unless they stick him behind bars (Unlikely seeing as there is no room, not even for people that carry knives) then how do they go about making him pay £20k+ in arrears from an income of only JSA?

    Being Ltd company he is hidden, as he can pay himself a pittance and keep everything else in the company. It's a loophole that the CSA just cannot get around.

    I would personally stop wasting my time and effort and move on from the complete waste of space as it's highly unlikely that you are ever going to get anything. He will keep moving from pillar to post everytime they catch up with him and there is not a lot anyone can do about it.
