Credit card claims-questions

Hi there.
I made some credit card claims before the recommendation of £12 charge to be a fair representation of charges.
My response was to pay me a paultry sum of the fee claimed. I rejected this, but they paid me the money anyway. I want to submit the claim to a court now. do I need to deduct this from the total claimed?
Secondly, I want to make some fresh claims with credit card companies. when making the claim, shall I include all charges including those of £12 because it was only a recommended fair fee, not set in stone, or should I submit all claims not including those of £12 or below?
