    I have been seen by mental health teams for about 6 years now,
    last time I went was a few years back and she said it sounds like I have bipolar disorder due to my moods, depression, mania etc. This scared me as I didn't know what it was, I never went back for diagnosis just (again) put it to back of my mind. I don't know if it's anything to do with this but it does seem money is a majour factor in my problems. My dad has been diagnosed with bipolar 1 and I have only a few months ago found that out! Should I mention this?
    Ok the real reason I kept income support going was because my violent ex partner was taking me through court (fresh out of prison) to get custody of our son, I needed the legal aid.When we were together he went to jail for assaulting me, police officers etc. We split n he went back to jail for other assaults
    When it was sorted he was to have my son every weekend....

    .He was taking my son to pubs and getting drunk in his care I had to take him back to court, he was leaving him in the care of a dog win a flat above the pub he was getting arseholed in downstairs.... should i tell them this? or will I have to then pay the £4000ish court fees if i do??
    I am in such a mess. I was planning on canceling the income support as soon as the court payment was finalised which should have been done by now, still waiting for letter. It was never for the money, just the legal aid xxxx

    I'm sure you do want to "pay the money back" now that you've been caught - as a prison term as the alternative isn't looking too rosy is it?

    You didn't just forget. That's just insulting people's intelligence. If you try and fob people off with that lie, then people are going to just see you as a liar as well as a fraud.

    I suggest you get yourself some legal help - and quickly.
    Thanks for the nice comments, as I have just explained I did it for my 5 year old son! legal aid. I didn't forget i put it to the back of my mind!!

    Those comments were made based on your original information so there is no point getting shirty with the response.

    I'm dubious about all this but, if you did do it for the legal aid, you are surely guilty of fraud for that too?

    The MH Teams do not let those with bipolar just fall out of the system. Equally, if it was an issue for you, you would have sought help.

    As others have said, stop making up stories and admit what you have done. Your previous posts show your attitude towards money. You need to start taking responsibility for your actions, before the legal system takes all your rights away from you.

    You just need to go along & tell the truth, by which I mean being perfectly honest. It's no good really saying things like you forgot you shouldn't be claiming IS with your boyfriend living there too.

    Just put your hands up & say sorry, for honesty is the only way to get a reasonable result. If you're perfectly honest then the investigator's will be able to report that you co-operated fully without trying to cover your actions with excuses. The likely outcome for honesty is to have to pay the money back, end of story.

    The other outcome if DWP feel you've deliberately claimed whilst knowing you were not entitled to IS, or that you have been lying or distorting the truth in the interview under caution, is that you could be taken to court, have to pay the money back with penalty payment on top & either face a jail sentance or a court fine.

    You took a chance when you continued to claim IS & it didn't pay off. Now it's time to face the music alas. Be prepared for some anxious weeks waiting for the outcome of the interview, as you won't be told straight away. The actual decision is made by somebody higher up than the investigating officers, although the investigating officers do have some input.

    Unless you have an official diagnosis & a cpn who can be present at the interview, pleading mental illness won't help you at all.
    The bigger the bargain, the better I feel.

    I should mention that there's only one of me, don't confuse me with others of the same name.

    No I agree, especially when there is children and a violent ex in the picture!

    Just tell the truth and take your punishment , i doubt it was be a prison sentance if this is your first offence. Rightfully , you should have to pay the money back and maybe a fine too i should imagine.

    It is extremely unlikely that you would get jail. I'm sorry I didn't see this thread sooner. Let us know how it goes. You will be forced to pay the money back, but as for jail, unless this is a serial offence, not a chance. You are a mother. The courts don't like imprisoning mothers. Plus if everyone who commited benefit fraud was jailed, the prisons would be fuller than they are already.
