Misleading Tariff Advert from CPW ?? What do I do ?
I knew it would not be long before something did not go right for me.
Less than 2 weeks ago I decided to go for the offer that the CPW had in conjuction with T-mobile
Based on their 'March Madness' brochure, the Tariff states:
£35/mnth
upto 900 mins x network
upto 1800 txts
30 inc x net video calling
itemised billing £1.50
(then it goes on the state the call prices per min etc)
There is also a note at the bottom that states that the inc video calling is only applicable when a video calling enabled phone is purchased.
Offer was 9 mnths half price (claim it back after so months)
Excited with this I tried the video calling out with some of my mates.....
I then managed to get online and view my account/bill.
To my Horror there were charges showing against the video calls.
I emailed T Mobile and they phoned to explain that video calling is NOT included in any of their tariffs.
As it was sold via a 3rd Party I would need to take it up with them (CPW)
As a goodwill gesture she refunded what was only £1.30 for video calling
I went in store and expalined the situation to the Sales Assistant.
He seemed on my side and proceeded to contact the CPW helpdesk. (It was CLEAR that the video calling was included in the tariff)
The said they could not have printed it without the sayso of Tmobile.
He then was advised by CPW H/O to contact Tmobile, to which they confirmed they did not offer such a tariff.
After the 2 calls he said that he would give me a ring as it was taking a while...
He has now com back to me stating that the CPW H/O says its a Misprint
OMG !!
apparently on Page 3 of the brochure there is a disclaimer..... !!!!!! ??
So they say they are sending me a cheq for £15 as a goodwill gesture ..
30 x net video calling mins = £15 per month x 18 monts of the contract = £270
mmmmhhhhhh am i missing something.....
I said that I may not use ALL the mins and would only want to claim back what i used (if any) Which I think is fair
Any guidance as where i stand ?
Was thinking of contacting Consumer advice....
Anyone with a 'March Madness' offers from the CPW have a look !!
any advice GREATLY appreciated !!

Have you spoken to trading standards? Seems like a clear example of misselling. They should be able to advise you.0

Give them a letter demanding return of the missold funds (£270) or you'll issue a county court claim.
Then follow it up if they fail to respond/refuse. As long as you have the original advertisement you will not struggle to get this back. Make sure any correspondance between you is done in writing, and keep a copy (any phone calls, tell them to provide you the information in writing).
What they've done is absolutely criminal, and I hope you teach them a lesson.DONE: Great North Run 09! Raised £452 for the National Autistic Society

Then again OSPS have done something similar to me (bought a contract and signed me up to another (with less cashback) - even said I forged their own confirmation email!) and I am not sure they no longer engage in this sort of activity.
But to the OP: go for it!0 -
I'd complain directly to the owner of CPW, don't bother with customer services ...

Do you have a printout of the webpage/email where it stated that video calls were included?0

Hi,
I'm gonna give Consumer Direct a ring later..... see what they say and if they suggest Trading standards.
I do have the Brochure 'March Madness' that is widely avaliable on the display's in the CPW....
At the back of it there are lists of tariff for ALL the providers for both PAYG and Pay monthly.
Anyone with one.... have a look...
CLEARLY says it includes 30 X net mins..... EVEN the sales assistant agreed with me !!
Don't forget to THANK ME !!

it might be a way for you to get out of your contract, but i doubt you're going to get £270 worth of stuff...
if they let u out of the contract, I get 25 mins of video calls included a month on 3 (I think on most tarriffs)
I've also been with 3 for over 12 mo and not had any real probs (before the anti3 brigade jump in)0 -
Don't get me wrong....
I'm unlikely to use ALL the Video calling minutes........
I just feel that I shouldnot be charged for what I do use........
I'n not looking for a Cheque for £270.........
I'd be happy claiming any video minutes used in arrears....
......... But don't want to be out of pocket based on a tariff that was sold to me.....now having to pay for something that was 'included'

Spoke with Consumer Direct this morning.

Based on my situation, the Law is on my side if I want to cancel the Contract.
HOWEVER, it is NOT on my side with regards to the supposedly included Video calls.
As Tmobile have refunded me and I am at no financial loss.............
I'm happy with the other tems of the contract, just a bit miffed that the Video Calls were not included.
It was what sold me the 'deal'
Consumer Direct did advise me that they would be talking this up with Trading Standards as they should not be advertising in such a way.
(A bit confused at this point) as if it needs to be taken up with TS then I thought I may be in a stronger position.......
Ahwell, at least I've found out where I stand !!
I might give them a letter, just to emphasize my dissapointment !! :mad:Don't forget to THANK ME !!

There you go then,
Cancel the contract. You can keep the handset (as this was essentially provided 'free').
Take out another contract, sell the phone. Winner!DONE: Great North Run 09! Raised £452 for the National Autistic Society
