travel agent mistake - can they up price?

    I disagree. Thomsons build your own holidays often have accomadtion for £2 a night.

    As for their t and c they did not have getout clause IMO. The one listed by DMG only said their web prices are subject to change...BUT not after you have booked it.

    Hi, We booked a holiday last month on the ULOOKUBOOK website got the email through confirming our flights,hotel and transfer and then about an hour later after booking we got a telephone call from them saying our flights had failed and were actually nearly £400 dearer and that we had not booked our hold luggage which would be another£80 for our party!So our reasonable holiday had jumped up another £480.They told us we would have to pay or we could cancel.
    We said no we were not paying we had booked the holiday at that price so if we could not get it we would cancel.The lady on the phone said fine she would cancel our booking straight away.
    Got another email to say our booking was cancelled and a reciept to say we had been refunded the original price of the holiday.
    2 weeks later our credit card statement came in and yes you guessed it the holiday was on it and had not been refunded.
    Phone calls later they said it had been refunded when it clearly had not been put back onto our credit card.
    Phoned yet again on Tuesday there and got told there had been a problem with their banking and yes our refund had not gone through correctly.
    We phoned our credit card yesterday and guess what-the refund was still not back on!Credit card has now said they can get the full refund back after 30 days of our receipt from ULOOKUBOOK which is on Monday.
    The whole episode has definately put us off booking holidays through these so called "cheaper"holiday companies.
    I cant understand why when the holiday was cancelled 1 hour after booking they took off the exact price we were quoted online when we were told the flights had failed!
    Here`s hoping we get our money refunded to our credit card on Monday!

    This is (arguably) an E&OE clause, though it could be phrased more precisely.

    Even having taken the above into account, you will have great difficulty arguing against the argument that there has been a Unilateral Mistake, in which case the contract can be rescinded.

    The OP said that they'd received a confirmation email, however, this isn't necessarily the same as a confirmation invoice and in which case it would give more weight to the fact that the supplier can cancel.

    I know that when I used to work for a large TO the legal dept took a great deal of interest in the wording of the booking confirmation email so that it would be considered as letting the customer know that their "offer" had been received, but not yet "accepted" by the company
